Darba vides faktoru un nelaimes gadījumu darbā novēršanas tiesiskais regulējums

Abstract

Bakalaura darbā “Darba vides faktoru tiesiskais regulējums un tā ietekme uz nelaimes gadījumu darbā novēršanu” autore pēta būtisku darba aizsardzības jomu, kas ir darba vides faktoru un nelaimes gadījumu darbā novēršanas tiesiskais regulējums un tā piemērošana Latvijā. Darba devēja pienākums ir novērtēt darba vides faktorus ar kādiem var saskarties nodarbinātie darba vidē. Šie faktori ir uzskaitīti 2007.gada 2.oktobra Ministru kabineta noteikumu Nr. 660 “Darba vides iekšējās uzraudzības veikšanas kārtība” 1.pielikumā. Noteikumu pielikumā nav uzskatīti visi darba vides faktori ar, kādiem darba procesā var saskarties nodarbinātie, kas nozīmē, ka darba vides faktori tiek izvērtēti nepilnīgi, kas ir tiešs cēlonis nelaimes gadījumiem darbā un arodsaslimšanām. Līdz ar to darba mērķis ir, analizējot darba vides faktoru tiesisko regulējumu un tā ietekmi uz nelaimes gadījumu darbā novēršanu normatīvajos aktos un literatūrā, konstatēt problemātiku un ieteikt normatīvo aktu pilnveidi. Bakalaura darba galvenie rezultāti saistīti ar to, ka 2007.gada 2.oktobra Ministru kabineta noteikumu Nr. 660 “Darba vides iekšējās uzraudzības veikšanas kārtība” 1.pielikumā nav uzskaitīti visi darba vides faktori ar, ko darba vidē var saskarties nodarbinātie. Bakalaura darbs sastāv no 67 lappusēm, no kurām pamatapjomu veido 61 lapa. Darbā izmantots 101 literatūras avots.

In bachelor work "Legal regulation of work environment factors and its impact on the prevention of accidents at work", the author studies an important field of labor protection, which is the legal regulation of work environment factors and the prevention of accidents at work and its application in Latvia. The employer's responsibility is to evaluate the factors of the work environment which may be encountered by employees in the workplace. These factors are listed in the 1st annex of Cabinet of Ministers Regulation No. 660 “Procedures for the Performance of Internal Supervision of the Work Environment” (2 Oktober 2007). The annex to the regulations does not consider all factors of the work environment that employees may encounter during the work process, which means that the work environment factors are evaluated incompletely, which is a direct cause of workplace accidents and occupational diseases. Therefore, the aim of the work is, by analyzing the legal regulation of the working environment factors and its influence on the prevention of accidents at work in regulatory acts and literature, to identify the problems and recommend the improvement of the problems. The main results of the bachelor are related to the fact that in the 1st annex of Cabinet of Ministers Regulation No. 660 “Procedures for the Performance of Internal Supervision of the Work Environment” (2 Oktober 2007) not all work environment factors are listed which employees may encounter in the workplace. The bachelor consists of 67 pages, of which 61 pages make the main volume. 101 literary sources are used in the work.
