Valsts policijas formas tērpu iepirkuma tiesiskie aspekti

Abstract

Pētījuma darba mērķis ir Valsts policijas formas tērpu iepirkumu analīze, izmantojot dabisko tiesību skolas pieeju tiesisko situāciju vērtēšanā, problēmu izzināšana un to novēršanas tiesisko risinājumu meklējumi. Pētījums ir aktuāls saistībā ar pieņemto koncepciju par Valsts policijas formas tērpu nomaiņu uz cita dizaina formas tērpiem līdz 2024. gada vasarai. Šīs koncepcijas īstenošana ir prasījusi virkni iepirkumu, kuri saskārušies ar dažādām problēmām un daļēji beigušies bez rezultāta, savukārt citos gadījumos sasniegtais rezultāts iespējams neatbilst sākotnēji deklarētajam. Pētījums parāda arī to, ka šādu situāciju veidošanās saistībā ar valsts policijas materiāli tehnisko nodrošinājumu neveidojas pirmo reizi, un tajā mēģināts noteikt šādas situācijas pastāvēšanas iemeslus un to dabu, pamatā pievēršot uzmanību jautājumam, kādā mērā tieši tiesiski apsvērumi ir bijuši tam par pamatu. Šobrīd Valsts kontroles Finanšu revīzija par 2022. gadu, Iekšlietu ministrijā, secinājusi, ka paredzētais finansējums “Jaunā dizaina formas tērpu un to sastāvdaļu iegāde Valsts policijas amatpersonām.”, nav izlietots atbilstoši, jo Valsts policijai nav izdevies veiksmīgi pabeigt iepirkuma procedūru un noslēgt līgumus par formas tērpu iegādi. Darbā secīgi tiek apskatīta šāda tipa iepirkumu vēsture Valsts policijā, konkrētā posma iepirkumu gaita un izmantotie risinājumi, ciktāl tie norādīti iepirkuma dokumentos un tieši izsecināmi no tiem, tiek vērtēta iepirkumu rezultātu atbilstība deklarētajam mērķim, un mērķa deklarācijas atbilstība situācijai, kuru definējis tiesību normu komplekss, kas regulē Valsts policijas uzbūvi. Noslēgumā tiek noteiktas galvenās problēmsituācijas, kas kavējušas sekmīgu iepirkumu norisi un analizēta to daba, modelēti iespējamie alternatīvie risinājumi konstatētajām problēmsituācijām, lai izstrādātu iespējamos tiesiskos mehānismus to risināšanai. Vadoties no pētnieciskajā darbā gūtajām atziņām un secinājumiem, darba autore izsaka priekšlikumu veikt grozījumus Publisko iepirkumu likumā, precīzāk definējot subjektu kompetences, kā arī paplašinot uzraugošo institūciju kompetences lauku, lai tas atbilstu valsts tiesību sistēmas galvenajiem principiem. Pētnieciskais darbs izklāstīts uz 58 lapām.

The aim of this research is to analyze the procurement of uniforms for the State Police using the natural law school approach to evaluate legal situations. The goal is to identify problems and seek legal solutions to prevent them. This study is pertinent in light of the adopted concept to change the State Police uniforms to a different design by the summer of 2024. The implementation of this concept has led to a series of procurements, encountering various issues. Some procurements ended without results, while in other cases, the achieved outcome may not align with the initially declared objectives. The research also reveals that such challenges in the material and technical support of the state police have occurred before. It attempts to determine the reasons behind these situations, with a primary focus on the extent to which legal considerations have contributed to them. As of the Financial Audit of the State Audit Office for 2022 at the Ministry of the Interior, it has been concluded that the allocated funding for the "Purchase of new design uniforms and their components for State Police officials" was not appropriately utilized. The State Police failed to successfully complete the procurement procedure and conclude contracts for the purchase of uniforms. The research systematically examines the history of such procurements in the State Police, the procurement process at specific stages, and the solutions employed, as specified in procurement documents and derived directly from regulations governing the structure of the State Police. The paper concludes by identifying the main problematic situations that impeded successful procurement, analyzing their nature, and modeling possible alternative solutions. This is done to develop potential legal mechanisms for resolving these issues. Based on the findings and conclusions, the author proposes amendments to the Public Procurement Law, aiming to define the competences of the involved parties more precisely and expand the supervisory institutions' field of competence to align with the main principles of the national legal system. The research work is presented across 58 pages.
