Zādzības kvalifikācijas problēmas

Abstract

Autora izvēlētā bakalaura darba tēma “ Zādzības kvalifikācijas problēmas”. Tēmas aktualitāte tiek pamatota ar to, ka viens no izplatītākajiem mantas nolaupīšanas veidiem ir zādzība. 2022.gadā aptuveni 50% noziedzīgu nodarījumu bija vērsti pret īpašuma interesēm, tajā skaitā aptuveni 28% sastādīja zādzības. Praksē dažreiz rodas nepieciešamība zādzību norobežot no citiem līdzīga rakstura nodarījumiem, piemēram, no laupīšanas un krāpšanas. Svarīgi arī norobežot zādzību no noziedzīgiem nodarījumiem, kuri pilnībā vai daļēji satur zādzības pazīmes. No tā, cik likumīga, taisnīga un pamatota būs zādzības kvalifikācija, lielā mērā ir atkarīga Krimināllikuma mērķu sasniegšana. Bakalaura darba mērķis ir pētīt zādzības kvalifikācijas problēmas un izvirzīt priekšlikumus zādzības tiesiskā regulējuma un piemērošanas praksē pilnveidei. Bakalaura darbā autors sniedza nolaupīšanas vispārīgu aprakstu. Zādzības sastāva salīdzinošās analīzes gaitā autors veica zādzības šo analīzi pēc noziedzīga nodarījuma objekta, priekšmeta, objektīvās puses un subjektīvās puses. Darbā arī pētīti tādu noziedzīgu nodarījumu sastāvi, kuri pilnībā vai daļēji satur zādzības pazīmes. In the course of the comparative analysis of the composition of theft, the author performed this analysis of theft according to the object, object, objective side and subjective side of the crime. The work also researches the composition of such crimes, which fully or partially contain features of theft. At the end of the work, the author proposed proposals for the improvement of the legal regulation of theft and its application in practice.
