Sociālā naida un nesaticības izraisīšanas krimināltiesiskais regulējums un tā piemērošana

Abstract

Bakalaura darba nosaukums ir sociālā naida un nesaticības izraisīšanas krimināltiesiskais regulējums un tā piemērošana. Naida noziegumu tēma ir ļoti aktuāla problēma, to pēdējos gados arī ietekmēja notiekošais karš Ukrainā. Policijas darbinieku neprecīza noziedzīgo nodarījumu kvalifikācija noved pie tā, ka statistika par sociālā naida noziegumiem neveidojas. Svarīgi ir novērst šos naida noziegumus, jo to sekas ietekmē visu sabiedrību kopumā. Tiesiskā regulējuma grozījumi policijas darbiniekiem ļautu vieglāk izmeklēt šīs naida noziegumu lietas, tas radītu arī lielāku uzticēšanos no sabiedrības puses. Ja sabiedrība kļūtu aktīvāka un vairāk ziņotu par naida noziegumiem, tos būtu vieglāk ierobežot atbildīgajām iestādēm. Šobrīd sabiedrība ir ļoti apdāvināta saskarē ar mūsdienu tehnoloģijām, kas ļauj daudz veiklāk paust savu viedokli sabiedrībā un mēģināt ar to ietekmēt arī pārējo sabiedrību, vēršoties pie tām personu grupām, kas ir mazāk aizsargātas. Tas vien nozīmē, ka tiesībsargājošās iestādes ir ļoti vājas šajā jautājumā un tāpēc viena no pētāmajām problēmām būs trūkumi tiesiskajā regulējumā. Darba mērķis ir analizējot sociālā naida un nesaticības izraisīšanas krimināltiesisko regulējumu, konstatēt problēmas un ieteikt risinājumus kā efektīvāk ierobežot naida noziegumus. Darbs tiks iedalīts trīs nodaļās. Pirmā nodaļa “Jēdzienu skaidrojums”, otrā nodaļa “Sociālā naida un nesaticības izraisīšanas tiesiskais regulējums”, trešā nodaļa “Sociālā naida un nesaticības izraisīšanas piemērošana praksē”. Atbildot uz pētījuma jautājumiem jānorāda, naida noziegumi var atstāt ilgstošas sekas, kā arī tiesiskais regulējums nav pietiekošs, lai novērstu sociālā naida un nesaticības izraisīšanas novēršanu. Mūsdienu tehnoloģijas attīstās un naida noziegumi paliek aktuālāki. Bakalaura darbā tiks izmantoti dažādi literatūras avoti: normatīvie akti, tai skaitā “Krimināllikums”, “Kriminālprocesa likums”, likums “Par Krimināllikuma spēkā stāšanās un piemērošanas kārtību”, Krimināllikuma komentāri, Krimināllikuma grozījumi un interneta resursos pieejamie apkopojumi un metodiskie ieteikumi. Darba autore analizēs publiski pieejamus avotus, saistībā ar naida noziegumiem un to piemērošanas problēmām. Kopējais lappušu skaits bakalaura darbā ir 56, izmantotie literatūras avoti kopā 52 normatīvie akti 7 , literatūra 8 un elektroniskie resursi 37. The title of the Bachelor's work is the criminal justice framework for social hatred and insatiation and its application. The topic of hate crimes is a very pressing problem, also influenced in recent years by the ongoing war in Ukraine. Inaccurate qualifications of criminal offences by police officers lead to statistics on social hate crimes not forming. It is important to prevent these hate crimes because their consequences affect society as a whole. Amendments to the legal framework would make it easier for police officers to investigate these hate crime cases, which would also create more trust on the part of the public. If the public became more active and reported hate crimes more, they would be easier to limit to the authorities responsible. Right now, society is very gifted in the face of modern technology, which makes it much more agile to express your opinion in society and try to influence the rest of society with it too, reaching out to those groups of people who are vulnerable. This alone means that law enforcement agencies are very weak on this issue and therefore one of the problems to be investigated will be shortcomings in the legal framework. The work aims to analyse the criminal justice framework for social hatred and insatiation, identify problems and suggest solutions to curb hate crime more effectively. The work will be divided into three chapters. Chapter one “interpretation of concepts”, Chapter two “legal framework for the creation of social hatred and incompatibilities”, Chapter three “application of social hatred and incompatibilities in practice”. In response to questions from the study, hate crimes can have long-lasting consequences and the legal framework is not sufficient to prevent social hatred and insatiation. Modern technology is evolving and hate crimes remain more pressing. The Bachelor's work will use various sources of literature: laws and regulations, including the Criminal Law, the Criminal Procedure Law, the Law on procedures for the coming into force and application of the Criminal Law, comments of the Criminal Law, amendments to the Criminal Law and compilations and methodological recommendations available in Internet resources. The author will analyse publicly available sources, in relation to hate crimes and problems with their application. The total number of pages in the Bachelor's work is 56, the literary sources used a total of 52 laws and regulations 7, literature 8 and electronic resources 37.
