Koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā krimināltiesiskais raksturojums

Abstract

Bakalaura darba tēma ir “Koruptīvo noziedzīgo nodarījumu valsts institūciju krimināltiesiskais raksturojums”. Darba autore ir Rīgas Stradiņu universitātes Juridiskās fakultātes Profesionālās bakalaura studiju programmas “Policijas darbs” studente Mārīte Rimicāne. Bakalaura darba zinātniskais vadītājs ir Dr.iur. Jānis Baumanis. Bakalaura darba mērķis ir izpētīt koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā kvalifikācijas īpatnības. Lai sasniegtu izvirzīto mērķi, nepieciešams veikt šādus uzdevumus: 1. Izpētīt koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā vispārīgo krimināltiesisko raksturojumu; 2. Izpētīt koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā objektīvo pazīmju kopumu; 3. Izpētīt koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā subjektīvo pazīmju kopumu; 4. Izpētīt koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā kvalifikācijas jautājumus. Pētījuma izstrādes laikā izmantotās metodes: aprakstošā, vēsturiskā, teleoloģiskā, salīdzinošā, gramatiskā un sistēmiskā metode. Bakalaura darbs sastāv no četrām nodaļām. Pirmajā nodaļā tika apskatīts koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā vispārīgs krimināltiesiskais raksturojums, kā arī šo noziedzīgo nodarījumu vēsturiskā attīstība un tiesiskais regulējums ārvalstīs. Otrajā nodaļā tika aplūkots koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā objektīvo pazīmju kopums. Trešajā nodaļā tika aplūkots koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā subjektīvo pazīmju kopums. Ceturtajā nodaļā tika apskatītas koruptīvo noziedzīgo nodarījumu valsts institūciju dienestā kvalifikācijas problēmas. Bakalaura darba apjoms 51lpp

The subject of the Bachelor's work is “Criminal legal characterisation of State institutions of Corrupt Criminal offences”. The author of the work is Marite Rimicane, a student of the Faculty of Law of Stradins University of Riga's Faculty of Vocational Bachelor's study programme “Police work”. The scientific head of Bachelor's work is Dr. IUR. Janis Baumanis. The purpose of the Bachelor's work is to explore the specificities of qualification of corruption offences in the Service of State institutions. In order to achieve the objective pursued, it is necessary to perform the following tasks: 1. To examine the general criminal legal characterisation of corruption offences in the Service of State institutions; 2. To examine a set of objective features of corruption offences in the service of State institutions; 3. To examine a set of subjective characteristics of corruption offences in the service of State institutions; 4. To examine the qualification issues of corruption offences in the Service of State institutions. Methods used during study development: descriptive, historical, teleological, comparative, grammatical and systemic. The Bachelor's work consists of four chapters. Chapter one dealt with the general criminal legal characterisation of corruption offences in the service of State institutions, as well as the historical development of such offences and the legal framework abroad. The second chapter dealt with a set of objective characteristics of corruption offences in the service of public authorities. Chapter three dealt with a set of subjective characteristics of corruption offences in the service of public authorities. Chapter four dealt with the qualification problems of corruption offences in the Service of State institutions. Bachelor's work volume 51 pp
