Nelikumīgu alkoholisko dzērienu aprites ierobežošanas krimināltiesiskais regulējums

Abstract

Bakalaura darba temats ir „Nelikumīgu alkoholisko dzērienu aprites ierobežošanas krimināltiesiskais regulējums”. Tēmas aktualitāti nosaka tas, ka politikas plānošanas dokumentos gadu no gada ir uzsvērti galvenie virzieni alkoholisko dzērienu patēriņa mazināšanai un alkoholisma ierobežošanai, attiecīgi, -alkoholisko dzērienu piedāvājuma un pieprasījuma samazināšana, sabiedrībai riskantas un kaitējošas alkoholisko dzērienu lietošanas samazināšana un alkohola lietošanas, to seku monitorings un sabiedrības informēšana. Pastāvot augstam gan legālajam, gan nelegālajam alkohola patēriņam valstī, būtiski izvērtēt, vai Krimināllikumā noteiktā atbildība un sodu piemērošanas prakse ir pietiekami efektīva, lai atturētu pārkāpējus no jaunu noziedzīgu nodarījumu izdarīšanas, kā arī būtiski izvērtēt, vai izmaiņas Krimināllikuma normās, kas regulē nelegālu alkohola apriti, pozitīvi ietekmētu alkohola aprites un patēriņa negatīvos rādītājus. Bakalaura darba mērķis ir analizēt kriminālatbildības par nelikumīgu alkoholisko dzērienu apriti tiesisko regulējumu un tā piemērošanas praksi, konstatēt ar to saistītos problēmjautājumus un izstrādāt iespējamos risinājumus tiem. Pētījuma jautājumi: Kāda ir alkohola aprites ierobežojumu un kontroles nepieciešamība? Kādas ir Krimināllikuma 221. panta, 2211.panta, 2212. panta noziedzīgu nodarījumu sastāva pazīmes? Kādas ir alkohola aprites noziedzīgu nodarījumu kvalifikācijas problēmas. Kāda ir tiesu prakse kriminālsoda piemērošanā par nelegāla alkohola aprites noziedzīgu nodarījumu? Pētījuma bāze: Bakalaura darbā autors analizēs un pētīs normatīvo regulējumu, publiski pieejamās publikācijas no nozaru speciālistiem, kā arī valsts pārvalžu iestāžu publicēto informāciju, nacionālo un starptautisko tiesu praksi. Pētījumā normatīvā bāze ir krimināltiesību regulējošās tiesību normas. Pētījuma empīriskais pamats ir Latvijas un starptautisko tiesu spriedumi, zinātniskās publikācijās. Pētījumā tiek izmantoti publicēti statistikas dati no dažādiem avotiem. The topic of the bachelor's thesis is "Criminal regulation of the restriction of circulation of illegal alcoholic beverages". The topicality of the topic is determined by the fact that the main directions for reducing the consumption of alcoholic beverages and limiting alcoholism are emphasized in the policy planning documents from year to year, respectively, -reducing the supply and demand of alcoholic beverages, reducing the consumption of alcoholic beverages that are risky and harmful to society, and monitoring the consequences of alcohol consumption and informing the public. Given the high level of both legal and illegal alcohol consumption in the country, it is important to assess whether the liability and punishment practices set out in the Criminal Law are effective enough to deter offenders from committing new crimes, as well as whether changes in the provisions of the Criminal Law that regulate illegal alcohol circulation, would positively affect the negative indicators of alcohol circulation and consumption. The aim of the bachelor's thesis is to analyze the legal regulation of criminal liability for illegal circulation of alcoholic beverages and its application practice, to identify related problems and to develop possible solutions for them. Research questions: What is the need for restrictions and control of alcohol circulation? What are the characteristics of the criminal offenses of Article 221, Article 2211, Article 2212 of the Criminal Law? What are the problems of qualification of criminal offenses of alcohol circulation. What is the judicial practice in applying the criminal penalty for the criminal offense of illegal alcohol distribution? Research basis: In the bachelor's thesis, the author will analyze and study the regulatory framework, publicly available publications from industry specialists, as well as information published by state administrative institutions, national and international court practice. In the study, the normative basis is the legal norms regulating criminal law. The empirical basis of the research is judgments of Latvian and international courts, in scientific publications. The study uses published statistics from various sources. Key words are Criminal Law, liability, alcohol circulation, illegal alcohol, unregistered alcohol, excise goods. The work is 53 pages. The work consists of three chapters, introduction, conclusions and proposals, using 73 literary sources.
