Krāpšana automatizētā datu apstrādes sistēmā

Abstract

Bakalaura darba tēma ir „Krāpšana automatizētā datu apstrādes sistēmā”. Darbā tiek apskatīts automatizētas datu apstrādes sistēmas jēdziens, krāpšanas automatizētā datu apstrādes sistēmā noziedzīga nodarījuma sastāvs un tā pazīmes, kā arī kriminālatbildības problemātika. Bakalaura darba mērķis ir izpētīt ar kriminālatbildību par izdarītu datorkrāpšanu, saistītos problēmjautājumus un sniegt iespējamos, to risinājumus. Bakalaura darba mērķa sasniegšanai izvirzīti sekojoši uzdevumi: • Izpētīt normatīvo aktu bāzi, kas reglamentē datorkrāpšanas kriminālatbildību; • Izpētīt un izprast automatizētas datu apstrādes sistēmas jēdzienu un tās tiesisko regulējumu; • Noskaidrot juristu viedokli un salīdzināt pastāvošo tiesu praksi par minēto tēmu; • Dot risinājumus, ieteikumus atklāto problēmu novēršanā. Bakalaura darba izstrādē izmantotās pētīšanas metodes: dokumentālā; izziņas/indukcijas; vēsturiskā; salīdzinošā. Darba apjoms 67 lpp. Darbā izmantoti 46 literatūras avoti. Bakalaura darbs sastāv no trīs nodaļām. Pirmā nodaļa ir veltīta, lai izprastu automatizētas datu apstrādes sistēmas jēdzienu un tiesisko regulējumu. Otrajā nodaļā tiek analizēts noziedzīga nodarījuma sastāvs, izpētot noziedzīga nodarījuma objektu, objektīvo pusi, subjektu un subjektīvo pusi. Trešā nodaļa tiek veltīta datorkrāpšanas kvalifikācijas problemātikai, kurā tiek apskatīta datorkrāpšanas nošķiršana no citiem noziedzīgiem nodarījumiem un datorkrāpšanas kvalifikācija pēc noziedzīgo nodarījumu kopības.

The subject of the bachelor thesis is "Fraud in an automated data processing system". The paper examines the concept of an automated data processing system, the composition of the crime of fraud in an automated data processing system and its features, as well as the issue of criminal liability. The aim of the bachelor's work is to investigate the criminal liability for computer fraud, related problems and to provide their possible solutions. In order to achieve the goal of the bachelor thesis, the following tasks have been set: • To study the base of regulatory acts that regulate the criminal liability of computer fraud; • To study and understand the concept of an automated data processing system and its legal regulation; • Clarify the opinion of lawyers and compare the existing court practice on the mentioned topic; • To give solutions, recommendations for the elimination of discovered problems. Research methods used in the development of the bachelor thesis: documentary; cognitions/inductions; historical; comparative. Thesis consists of 67 pages. 46 literature sources are used in the work. The bachelor thesis consists of three chapters. The first chapter is dedicated to understanding the concept and legal framework of an automated data processing system. The second chapter analyzes the composition of a criminal offense by examining the object, the objective side, the subject and the subjective side of a criminal offense. The third chapter is devoted to the problem of the qualification of computer fraud, which examines the separation of computer fraud from other criminal offenses and the qualification of computer fraud according to the totality of criminal offenses.
