Pašaizsardzības šaujamieroču aprites tiesiskā regulējuma izvērtējums

Abstract

Bakalaura darba tēmas nosaukums: Pašaizsardzības šaujamieroču aprites tiesiskā regulējuma izvērtējums. Ar pašaizsardzības šaujamieroču apriti kopumā, kā arī ar pielietošanu un izmantošanu saistītā tiesiskā reglamentācija Latvijas Republikā ir ietverta galvenokārt Ieroču aprites likumā un tam pakārtotajos Ministru kabineta noteikumos. Privātpersonu īpašumā esošie pašaizsardzības šaujamieroči var būt bīstami apkārtējiem, ja tie netiks pareizi glabāti, nēsāti, pielietoti vai izmantoti. Pētnieciskā darba izstrādes ietvaros, tēma tiks iztirzāta no diviem aspektiem – tiks pētīts spēkā esošais normatīvais regulējums un ar to saistītā problemātika, kā arī analizēti pašaizsardzības šaujamieroču izmantošanas un pielietošanas praktiskie aspekti, tādējādi pētot un analizējot mijiedarbību starp normatīvo regulējumu un praksi. Ņemot vērā pašaizsardzības šaujamieroču īpašnieku un reģistrēto šaujamieroču skaita pakāpenisko pieaugumu un šaujamieroču vispārējo bīstamības pakāpi, darba autors uzskata, ka darba ietvaros pētāmais jautājums ir aktuāls. Darba izstrādei tika izvirzīts mērķis – analizējot normatīvo regulējumu un tā piemērošanu par pašaizsardzības šaujamieroču apriti, identificēt problemātiku un ierosināt nepieciešamos grozījumus atsevišķu likuma normu uzlabošanai. Darba gaitā autors analizē pašaizsardzības šaujamieroču apriti Latvijas Republikā, kā arī veic pašaizsardzības šaujamieroču pielietošanas un izmantošanas tiesiskā pamata un praktisko aspektu analīzi. Darbs sastāv no ievada, trim nodaļā un nobeiguma. Darba kopējais apjoms ir 61 lpp. Darbā ir izmantoti 43 avoti, to skaitā Latvijas Republikas normatīvie akti, starptautiskie normatīvie akti, literārie avoti, tiesu prakse, statistikas dati un elektroniskie resursi.

Title of the bachelor’s work topic: Evaluation of the legal framework for the circulation of self – defence firearms. The legal regulation related to the circulation of self – defence firearms in general, as well as the use and use in the Republic of Latvia, is mainly contained in the law on the circulation of weapons and the Cabinet regulations subordinate thereto. Self – defence firearms owned by individuals can be dangerous to those around them if they are not properly stored, carried, applied or used. Within the framework of the development of the research work, the topic will be discussed from two aspects – the current regulatory framework and related problems will be studied, as well as the practical aspects of the use and application of self – defence firearms will be analysed, thus studying, and analysing the interaction between regulatory framework and practice. Given the gradual increase in the number of owners of self – defence firearms and registered firearms and the general degree of danger of firearms, the author of the work believes that the issue being studied within the framework of the work is relevant. The aim of the work is by analysing the regulatory framework and its application on the circulation of self – defence firearms, identify the problem and propose the necessary amendments to improve certain norms of the law. During the work writing process, the author analyses the circulation of self – defence firearms in the Republic of Latvia, as well as performs an analysis of the legal basis and practical aspects of the use and use of self – defence firearms. The work consists of an introduction, three chapters and conclusion. The total amount of work is 61 pages in the work was used 43 sources, including Latvian laws, international regulations, literary sources, court practice, statistics data and online sources.
