Personas datu aizsardzība veicot videonovērošanu

Abstract

Bakalaura darba „Personas datu aizsardzība veicot videonovērošanu” tēmas aktualitāte izriet no moderno tehnoloģiju attīstības un nepieciešamības tai piemērot mūsdienīgu tiesisko regulējumu. Par personas datu aizsardzības aktualitāti liecina arī datu aizsardzības regulējuma attīstība Eiropas Savienībā un Latvijā. Bakalaura darba mērķis ir izpētīt personas datu aizsardzību veicot videonovērošanu uzņēmumā un tam saistīto tiesisko regulējumu, konstatēt problēmjautājumus un ieteikt iespējamos risinājumus. Bakalaura darba ietvarā tiek izvirzīti 3 uzdevumi mērķa sasniegšanai – izpētīt personas datu apstrādes tiesisko regulējumu, jo īpaši regulējuma daļas, kas tiešā veidā attiecas uz videonovērošanu uzņēmumā, izanalizēt personas datu apstrādes tiesiskos pamatnosacījumus, lai videonovērošana uzņēmumā būtu tiesiska un videonovērošanā veikto personas datu apstrādes procesu un tā uzraudzību uzņēmumā. Bakalaura darba ietvarā tiek identificētas dažādas problēmas, kā, piemēram, nepieciešamo personas datu apstrādes apjoma pārsniegšana, tiesību aktu izvirzīto drošības prasību neievērošanas sekām, videokameru novietošanu pārkāpjot datu subjekta pamattiesības un citu praksē novērojamu pārkāpumu sasaiste ar tiesību aktos noteiktajām normām un to īstenošanu. Bakalaura darba ietvaros secināts, ka ir nepieciešams konkrēts regulējums videonovērošanas veikšanai uzņēmuma drošības vajadzībām, kā arī to, ka ar tiesisko regulējumu tiek ierobežota iespēja izmantot tehnoloģiski attīstītākos drošības – personas datu apstrādes veidus. Bakalaura darba apjoms ir 59 lpp.

The bachelor thesis topic “Protection of personal data through video surveillance” is highlighted by the development of modern technologies and the need to apply a modern legal framework to it. The development of the data protection framework in both the European Union and Latvia also shows the spotlight on the protection of personal data. The aim of the Bachelor thesis work is to explore the protection of personal data through company video surveillance and related legal frameworks, identify issues and suggest possible solutions. As a part of the Bachelor thesis work, 3 objectives are set to achieve the objective of examining the legal framework for the processing of personal data, in particular, parts of the framework directly related to video surveillance in the company, analyzing the legal framework for the processing of personal data, so that video surveillance in the company is legal and monitoring of personal data processing processes carried out in video surveillance. In the framework of the bachelor thesis work, various problems are identified, such as exceeding the required amount of personal data processing, the consequences for failing to comply with the safety requirements of the law, infringing the fundamental rights of the data subject and linking other breaches in practice to the statutory norms and their implementation. The findings of the bachelor thesis work require a specific framework for the performance of video surveillance for the safety of the company, as well as limiting the possibility of using the most technologically advanced ways of processing personal data. The amount of bachelor thesis work is 59 pages.
