Aktuālie tiesību jautājumi personu ar invaliditāti tiesību piemērošanā

Abstract

Personu ar invaliditāti tiesības sāka attīsties samērā nesen. Problemātika saistībā ar invaliditātes tiesībām bija tāda, ka Padomju laikā invalīdi nebija vērtēti un nosūtīti uz speciālām iestādēm, kur tie pavadīja atlikušo dzīves laiku un pēc Padomju varas krišanas, valstīm ir nepieciešams ilgs atkopšanās laiks un likumu izmaiņu pieņemšanā. Personu ar invaliditāti dzīves laikā saskarās ar daudziem šķēršļiem, kuri ir gan sabiedrības attieksme, gan vides pieejamība, kā arī likuma saprašana un pieņemšana. Apvienoto Nāciju Organizācijas Konvencija tika ratificēta 2010.gada 31.martā un lēnām to sāka ratificēt arī pārējās dalībvalstis, kas sniedza sabiedrībai lielāku izpratni par to, ka personas ar invaliditāti ir tādi paši cilvēki kā pārējie. Konvencijas parakstīšana kļuva par pagriezienu Latvijas likumu grozīšanas procesos, jo Konvencijas galvenie mērķi ir cilvēku vienlīdzības un nediskriminācijas ievērošana. Tomēr, joprojām ir vēl daudzas sfēras, kuras jāpilnveido, lai personas ar invaliditāti spētu dzīvot pilnvērtīgu dzīvi sabiedrībā un justos vienlīdzīgi ar pārējiem. Balstoties uz iepriekš minēto, bakalaura darba mērķis ir izpētīt personu ar invaliditātēm tiesības, identificēt problēmas un tādējādi sniegt iespējamos priekšlikumus nacionālā tiesiskā regulējuma pilnveidošanai. Lai sasniegtu mērķi, darbā tiks izvirzīti šādi uzdevumi: 1)izpētīt cilvēktiesību pielietojumus personām ar invaliditāti; 2) analizēt sabiedrībā piedāvātos pakalpojumus Latvijas tiesiskajā regulējumā personā ar invaliditāti; 3) analizēt Latvijas tiesiskos regulējumus un organizācijas ziņojumus par personām ar invaliditāti.

The rights of persons with disabilities began to develop relatively recently. The main problem with disability rights was that during the Soviet era, disabled people were not properly evaluated and sent to special institutions, where they could spend the rest of their lives, and after the fall of Soviet Union, countries need a long time to recover and accept the many changes in the law system. During the lifetime of persons with disabilities, they face many obstacles, which are both the attitude of the society and the accessibility of the environment,, as well as the understanding and acceptance of the law. The Convention of the United Nations Organization was ratified on March 31, 2010 and slowly the other member states also started to ratify it, which gave the society a greater understanding of the fact thet persons with disabilities are the same people as the rest. The signing of the Convention became a turning point in the process of amending Latvian laws because the main goals of the Convention are the observance of human equality and nondiscrimination. However, there are still many areas for persons with disabilieties which need to be improved so they could be able to live a fulfilled life in society and feel equal with others. Therefore, the aim of the bachelor thesis is to study the rights of persons with disabilities, identify problems and thus provide possible proposals for improving the national legal framework. In order to achieve the goal, the following tasks will be set in the work: 1) study the applications of human rights on persons with disabilities; 2) analyze the services offered in the society in the legal framework of Latvia for a person with a disability; 3) analyze Latvian legal regulations and organization reports on persons with disabilities.
