Abstract

Bakalaura darba tēma ir “Evaņģēliskās baznīcas cieņas un goda aizskārums un aizsardzība masu plašsaziņas līdzekļos“. Latvijā katrai tradicionālajai konfesijai valstī ir izdots oficiāls likums, kas regulē baznīcas attiecības ar valsti. Taču baznīcas t. i. juridiskas personas tiesiskās attiecības ar citu juridisko vai privātpersonu tiek regulētas vispārpieņemtā kārtībā. Viena no šādām juridiskajām personām, bez kuras nav iedomājama 21. gadsimta komunikācija, ir masu plašsaziņas līdzekļi, pie kuriem pieder arī dažādi interneta izklaides portāli un bulvāra prese. Neskatoties uz to, ka saskaņā ar tiesisko regulējumu masu informācijas līdzekļi vāc, sagatavo un izplata informāciju saskaņā ar Latvijas Republikas likumiem, šie masu mediji bieži vien publicē brīvi interpretētu informāciju, kas ir nievājoša rakstura un ne vienmēr atbilst realitātei. Ņemot vērā evaņģēliskās baznīcas pazemīgo attieksmi, Latvijas judikatūrā šādi tiesas spriedumi faktiski nav atrodami un zinātnieki šo jautājumu ir maz pētījuši. Bakalaura darba mērķis ir analizējot zinātnisko literatūru, tiesas nolēmumus un tiesisko regulējumu, izpētīt problemātiku un iespējamu tiesisko risinājumu evaņģēliskās baznīcas cieņas un goda aizskāruma gadījumā masu plašsaziņas līdzekļos Baltijas reģionā. Šī bakalaura dara struktūra sastāv no ievada, trīs nodaļām, divām apakšnodaļām, nobeiguma un deviņiem pielikumiem. Darba apjoms ir 56 lapas, darbā izmantoti 60 zinātniskie avoti. Darba pirmajā nodaļā ir vispārīgi raksturots cieņas un goda, kā arī cieņas un goda aizskāruma un aizsardzības jēdziens. Darba otrajā nodaļā ir analizēti baznīcas iekšējie normatīvie akti un Baltijas valstu tiesiskais regulējums baznīcas cieņas un goda aizsardzībai. Darba trešajā nodaļa ir izpētīti tiesas spriedumi un nolēmumi baznīcas cieņas un goda aizskāruma gadījumā. Pētījuma rezultātā sniegti secinājumi un piedāvāti priekšlikumi. The topic of the bachelor thesis is “Infringement and protection of dignity and honour of the Evangelical Church in the mass media”. In Latvia, an official law has been adopted for each traditional confession in the country, which regulates the church’s relations with the state. However, the legal relations of the church, i. e., a legal entity with another legal entity or a private person are regulated in accordance with the generally accepted procedures. One such legal entity, without which the communication in the 21st century is unimaginable, is the mass media, which also includes various online entertainment portals and the gutter press. Despite the fact that, in accordance with the legal framework, mass media collect, prepare and distribute information in accordance with the laws of the Republic of Latvia, these mass media often publish freely interpreted information that is derogatory in nature and does not always represent the facts. Considering the humble attitude of the Evangelical Church, such court judgments cannot actually be found in Latvian case law and scientists have not studied this issue enough. The objective of the bachelor thesis is to study the problematics and possible legal solution in case of infringement of dignity and honour of the Evangelical Church in the mass media in the Baltic region by analysing the scientific literature, court decisions and legal framework. The structure of this bachelor thesis consists of introduction, three chapters, two subchapters, conclusion and nine appendices. The volume of the thesis is 56 pages, 60 scientific sources have been used in the thesis. The first chapter of the thesis generally describes the concept of dignity and honour, as well as of the infringement and protection of dignity and honour. The second chapter of the thesis analyses the internal regulatory enactments of the Church and the legal framework of the Baltic States for the protection of dignity and honour of the Church. The third chapter of the thesis studies court verdicts and decisions in case of infringement of dignity and honour of the Church.
