Vecāku un bērnu tiesiskās attiecības, uzturēšanas un rūpēšanās pienākums ārpus laulības institūta Latvijā

Abstract

Bakalaura darbā tiek analizēts ārlaulības bērnu tiesiskās garantijas. Proti, ārlaulībā esošo vecāku tiesības un pienākumi, it īpaši tās tiesības, kas izriet no bērnu tiesību aizsardzības institūta. Autore analizē dažādu ar laulības, ārlaulības, kā arī nereģistrēto partnerattiecību saistītos tiesību aspektus. Latvijā pagājušā gadsimta trīsdesmitajos gados profesors A. Būmanis pētīja ārlaulības bērnu tiesisko stāvokli, tajā pašā laikā šis autors nevērtēja bērnu tiesību aizsardzības aspektus tās mūsdienu izpratnē. Līdz ar to autore šo tiesību institūtu analizē, ņemot par pamatu bērnu tiesības, kas ir saistītas ar tiesībām uz attīstību, veselību, izglītību utml., tas ir, tām bērna tiesībām, kas ir noteiktas Apvienoto Nāciju Organizācijas Bērnu tiesību konvencijā un citos starptautiskajos un nacionālajos tiesību aktos. Tajā pašā laikā pētījums neatklāj vienotus iemeslus, kāpēc persona izvēlas vienu nu vai otru kopdzīves formu. Tiek noskaidrots, kādi var būt laulības un ārpuslaulības savienības plusi un mīnusi. Analizētas vecāku tiesības, pienākumi attiecībā pret bērnu, t.i., uzturēšanas un rūpēšanās pienākumi, noskaidroti kopīgie un atšķirīgie laulības un ārpuslaulības institūta tiesiskie aspekti kopsakarā ar bērnu tiesību aizsardzību. Pētījumā norādīts, ka Latvijas esošais tiesiskais regulējums neatbilst starptautisko tiesību tendencēm. Tiek konstatēts, ka valstij ir pienākums nodrošināt, lai tās tiesiskais regulējums par ģimenes dzīves un bērnu tiesību aizsardzību atbilstu sabiedrības prasībām. Tiek analizēta statistika par laulību slēgšanu un šķiršanos 2021. gadā un izvirzīti secinājumi. Darba kopējais lappušu skaits ir 69.

The bachelor's work analyses the legal guarantees of extramarital children. In particular, the rights and obligations of parenthood parents, in particular those arising from the Institute for the Protection of Children's Rights. The author analyses various aspects of the law relating to marriage, extra marriage, as well as unregistered partnership. In Latvia, in the thirtieth years of the past century, Professor A. Bumanis studied the legal situation of extramarital children, while author did not appreciate aspects of the protection of children's rights in its contemporary sense. Consequently, the author of this right is analysed based on the rights of children related to the right to development, health, education etc., that is the rights of the child, which are laid down in the United Nations Convention on the Rights of the Child and other international and national legislation. At the same time, the study does not reveal uniform reasons why a person chooses one or another form of common life. It's figuring out what the benefits and minuses of marriage and non-marriage union can be. An analysis of parental rights, obligations towards children, i.e., maintenance and care obligations, clarifies the common and different legal aspects of marriage and non-marriage in relation to the protection of children's rights. The study indicated that the current legal framework of Latvia was not consistent with trends in international law. It is established that the State is obliged to ensure that its legal framework for the protection of family life and child rights is consistent with the requirements of society. Statistics on marriage closure and divorce in 2021 and conclusions are being analysed. The total number of pages is 69.
