Slepkavības mantkārīgā nolūkā kvalifikācijas problemātika

Abstract

Darba autors ir izstrādājis bakalaura darbu ar nosaukumu “Slepkavības mantkārīgā nolūkā kvalifikācijas problemātika”. Autors, kā bakalaura darba mērķi izvirzīja – izpētot slepkavības, kas izdarīta mantkārīgā nolūkā, kvalifikācijas un nošķiršanas problēmas, konstatēt tiesiskās problēmas un piedāvāt to risinājumus. Pētījuma objekts – slepkavības, kas izdarīta mantkārīgā nolūkā, ar kvalifikāciju saistītās tiesiskās attiecības. Pētījuma jautājums – kāds pamats domāt, ka regulējumā ir kvalifikācijas problēmas saistībā ar slepkavību, kas izdarīta mantkārīgā nolūkā, un kādi var būt risinājumu šo noziegumu pareizai kvalifikācijai? Neskatoties uz to, ka pēc autora domām Latvijas Republikas Krimināllikuma normatīvais regulējums ir pietiekošs, lai varētu atpazīt un kvalificēt noziegumus par slepkavībām mantkārīgā nolūkā, kā arī ir sniegti Latvijas Republikas Augstākās tiesas atzinumi par to piemērošanu, bet ir bijuši atšķirīgi viedokļi tiesību zinātnes ekspertu vidū, kā to darīt. Bakalaura darba izstrādes laikā tiks izmantota Latvijas un ārvalstu autoru darbi tiesību zinātnes jomā. Bez tam tiks izmantoti Latvijas Republikas normatīvie akti, interneta resursos pieejamā informācija, kā arī juridiskās prakses materiāli. Bakalaura darbs sastāv no 56 lappusēm. Bakalaura darbs sastāv no ievada, trim nodaļām, nobeigumā izteiktiem priekšlikumiem un secinājumiem un izmantoto avotu un bibliogrāfijas saraksta. The chosen subject of the thesis by the author is „The Issues of Qualifying Murder Motivated by Self-interest”. The author promotes the object of the thesis as – to explore murders, that have been committed by with intent to acquire wealth, problems of qualification and separation, and to offer solutions. The research object is – legal qualification of murders, which have been committed with intent to acquire wealth. The question of the research – what is the basis to believe that the legal qualification of murders, which have been committed with intent to acquire wealth is problematic and what are the solutions for qualifying these crimes appropriately. In spite of the author’s belief that the regulatory framework of the Criminal law of the Republic of Latvia is sufficient for acknowledgement and qualifying crimes of murder with the intent to acquire wealth and the conclusions made by the Supreme court senate of the Republic of Latvia, various legal experts are in disagreement over the legally appropriate qualifying means. During the development of the thesis the author will use scientific works of Latvian and foreign scientific law authors. Laws of the Republic of Latvia, internet resources and legal works will also be used. The volume of the thesis is 56 pages. The thesis consists of the 6introduction, three chapters, the conclusion that itself consists of proposals and conclusions of the author, list of used sources and bibliography.
