Abstract: | Bakalaura darbs ir veltīts transplantācijas nacionālā un starptautiskā tiesiskā regulējuma problemātikai. Latvijas Republikā ir nostiprināta prezumētās piekrišanas sistēma kā transplantācijas sistēma. Darbā tika analizēts nacionālais un starptautiskais tiesiskais regulējums, kas attiecas pārsvarā uz orgānu transplantāciju, cilvēktiesībām, ētiskajiem apsvērumiem, orgānu tirdzniecības aizliegumu. Neskatoties uz to, ka nacionālajā līmenī ir prezumētās piekrišanas sistēma un veikti attiecīgie grozījumi, lai nostiprinātu šo sistēmu un padarītu regulējumu skaidrāku, nacionālajos normatīvajos aktos ir saskatāmas dažādas nepilnības un nenoregulētie jautājumi. Darba rezultātā ir secināts, ka nacionālajam tiesiskajam regulējumam ir nepieciešami vairāki grozījumi, nosakot vienotu transplantācijas jēdzienu, ārstniecības personāla tiesisko aizsardzību, sazinoties ar tuviniekiem, kas nav klātesoši, potenciālā nepilngadīgā donora rīcībspēju, intensīvas terapijas ilgumu pēc smadzeņu nāves fakta konstatācijas, u.c. Bakalaura darbs sastāv no ievada, trīs nodaļām, kā arī secinājumiem un priekšlikumiem. Bakalaura darba apjoms ir 64 lpp. The bachelor thesis is dedicated to the problematics of the national and international legal framework of transplantation. In the Republic of Latvia, the presumed consent system has been established as the transplantation system. In the thesis it has been analysed both the national and international legal framework, which mainly concerns organ transplantation, human rights, ethical considerations, prohibition of organ trafficking. Despite the existence of a presumed consent system at national level and the relevant amendments to strengthen this system and clarify the regulation, various gaps and unregulated issues are identified in the national legislation. The paper concludes that the national legal framework requires a number of amendments, including a common concept and definition of transplantation, legal protection of medical personnel in matters of contacting relatives who are not present, legal capacity of the potential minor donor, the duration of intensive care after brain death has been established, etc. The thesis consists of an introduction, three chapters, conclusions and proposals part. The volume is 64 pages. |
