Saistību dzēšanas procedūra un tās izbeigšanas problemātika

Abstract

Anotācija Bakalaura darba tēma ir “Saistību dzēšanas procedūra un tās izbeigšanas problemātika”. Saistību dzēšanas procedūra fiziskās personas maksātnespējas procesā ir periods, kuru nosaka tiesa balstoties uz Maksātnespējas likumu, turpretim saistību dzēšanas procedūra regulē parādnieka tiesības un pienākumus visas procedūras norises laikā. Bakalaura darba mērķis ir izpētīt un izzināt fiziskās personas maksātnespējas procesa tiesību institūtu, identificēt problēmas un piedāvāt priekšlikumus spēkā esošo tiesību normu pilnveidošanai un vienveidīgai izpratnei. Bakalaura darba ietvaros ir analizēta saistību dzēšanas procedūras nozīme fiziskās personas maksātnespējas procesa ietvaros, saistību dzēšanas problemātiskākie aspekti fiziskās personas maksātnespējas procesā, tiesu prakse problēmjautājumos, kuru rezultātā tiek izbeigta saistību dzēšanas procedūra un nobeigumā apkopoti secinājumi un priekšlikumi. Autore secina, ka maksātnespējas tiesiskā regulējuma attīstību ir veidojoši vairāki plaši vērsti grozījumi, veicot izmaiņas likumā salīdzinoši īsā laika posmā, tomēr vienota pieeja, fiziskās personas maksātnespējas procesa problemātisko jautājumu risināšanā nav rasta, ne tiesiskā regulējuma ietvaros, ne tiesu praksē. Annotation The topic of the bachelor's thesis is "The Procedure for extinguishing obligtions in succession problem". The debt discharge procedure during the insolvency process of an individual is a period determined by the court based on the Insolvency Law, while the debt discharge procedure regulates the debtor's rights and obligations throughout the entire procedure. The aim of the bachelor's thesis is to research and explore the legal institutions of the insolvency process of an individual, identify problems and propose suggestions for the improvement of existing legal norms and for a unified understanding. The thesis analyzes the importance of the debt discharge procedure in the context of the insolvency process of a person, the most problematic aspects of debt discharge in the insolvency process of an individual, and court practice in problematic issues that result in the termination of the debt discharge procedure. The conclusions and proposals are summarized at the end. The author concludes that the development of legal regulation of insolvency has been shaped by several extensive amendments, making changes to the law in a relatively short period of time, however, a unified approach to solving problematic issues in the insolvency process of a person has not been found, neither in legal regulation nor in court practice.
