Administratīvā atbildība par amatpersonas likumīgo prasību nepildīšanu

Abstract

Bakalaura darba tēma ir „Administratīvā atbildība par amatpersonas likumīgo prasību nepildīšanu”. Bakalaura darba tēmas aktualitāte pamatojama ar to, ka amatpersonas likumīgo prasību nepildīšana būtiski ietekmē un traucē dienestam veikt normatīvajos aktos noteiktās funkcijas. Tas var nodarīt kaitējumu sabiedrības interesēm, un par to persona ir saucama pie atbildības. Kad šī prasība netiek ievērota rodas negatīva ietekme uz procesu un tās dalībniekiem. Darba mērķis ir analizējot atbildību par amatpersonas likumīgo prasību nepildīšanu, noskaidrot ar prasību nepildīšanu – saistīto problemātiku un piedāvāt risinājumus konstatētām problēmām. Autore sašaurina pētījuma robežas un pievērsīsies tikai policijas darbinieku kā amatpersonu likumīgo prasību neizpildei. Pētījuma bāze ir analizēt un pētīt atbildību par amatpersonas likumīgo prasību nepildīšanu. Darbā autore ņems vērā spēkā esošo Administratīvo sodu likumu par pārkāpumiem pārvaldes, sabiedriskās kārtības un valsts valodas lietošana jomā un Administratīvās atbildības likumu, kurš stājies spēkā 2020.gada 1.jūlijā un salīdzinās ar spēku zaudējušo Latvijas Administratīvo pārkāpumu kodeksu. Teorētisko bāzi veido arī informācija, kura iegūta no zinātniskiem darbiem administratīvajās tiesībās. Empīrisko bāzi veido informācija par pētāmo tēmu, kura atspoguļota Latvijas Republikas juridiskās prakses materiālos, tiesu judikatūrā un statistikas avotos. Bakalaura darbs sastāv no trim nodaļām un nobeiguma, kopā uz 57 lapām.

The topic of the bachelor's thesis is "Administrative liability for non-fulfilment of official's legal requirements”. The relevance of the bachelor's thesis topic is justified by the fact that the non-fulfillment of legitimate demands by officials significantly affects and hinders the performance of functions defined in regulatory acts. This can harm the interests of society, and the person responsible for it may be held accountable. When this requirement is not complied, a negative impact arises on the process and its participants. The aim of the work is to analyze the responsibility for non-fulfillment of legitimate demands by officials, identify the issues related to non-fulfillment of demands, and propose solutions to the identified problems. The author narrows down the scope of the research and focuses only on the non-fulfillment of legitimate demands by police officers as officials. The research is based on analyzing and studying the responsibility for non-fulfillment of legitimate demands by officials. The author will take into account the current Administrative Offences Law regarding violations in the field of governance, public order, and the use of the state language, as well as the Administrative Liability Law, which came into effect on July 1, 2020, and will compare it to the obsolete Latvian Administrative Violations Code. The theoretical framework is also based on information obtained from scientific works in administrative law. The empirical framework is formed by information on the research topic reflected in the materials of the legal practice of the Republic of Latvia, court judicature, and statistical sources.
