Ceļu satiksmes negadījums kā ceļu satiksmes drošības pārkāpums: tā reģistrācija, izskatīšana un lēmuma pieņemšana

Abstract

Bakalaura darba temats, ko autore aktualizēs ir “Ceļu satiksmes negadījums kā ceļu satiksmes drošības pārkāpums: tā reģistrācija, izskatīšana un lēmuma pieņemšana.” Darba apjoms sastāda 72 lpp ieskaitot 6 pielikumus. Latvija pasaules mērogā ir otrajā vietā ar visvairāk esošajiem ceļu satiksmes dalībnieku nāves gadījumiem, kas radušies ceļu satiksmes negadījuma rezultātā. Statistika norāda, ka pēdējos četros gados, bojā gājušo skaitam, kas saistīti ar ceļu satiksmes negadījumiem ir tendence samazināties, taču kopējais ceļu satiksmes negadījumu skaits valstī pēdējos trīs gados ir palielinājies. Ņemot vērā, ka negadījumu kopskaits nedaudz, bet palielinās, tomēr negadījumu skaits nav nulle, līdz ar ko šis temats ir nozīmīgs sabiedrībā. Jebkura neatļauta darbība veido cēloņsakarību starp izraisītu CSNg un kaitējumu personas mantai un veselībai. Šis ir galvenais priekšnoteikums, lai tiktu veikta CSNg reģistrēšana un tiktu saukta pie atbildības persona, kura ar savām prettiesiskajām darbībām aizskar citas personas likumiskās intereses, apdraudot kopējo ceļu satiksmes drošību. Pētījuma mērķis ir izanalizēt ceļu satiksmes negadījuma reģistrēšanas, izskatīšanas un administratīvā pārkāpuma lēmuma pieņemšanas un paziņošanas kārtību, konstatēt problemātiku un izstrādāt tiesiskā regulējuma grozījumus. Tā kā ceļu satiksmes negadījums ir cēloņsakarība notikušam administratīvajam pārkāpuma, uz CSNg reģistrēšanas protokola bāzes tiek uzsākta administratīvā lietvedība. Autore ir konstatējusi normatīvā regulējuma nepietiekamību katrā lietvedības stadijā. CSNg reģistrēšanas stadijā terminoloģija, kuru nosaka Ceļu satiksmes noteikumi, ar sistēmiskās interpretēšanas metodi neļauj pareizi kvalificēt negadījuma veidus atbilstoši normatīvajam aktu prasībām, tādējādi to nepieciešams pilnveidot. Administratīvās lietas izskatīšanas stadijā, nepietiekams regulējums liedz lietvedību pabeigt notikuma vietā, tādējādi papildus tiek noslogota iestāde, un netiek ievērots procesuālās ekonomijas princips. Administratīvās lietas lēmuma pieņemšanu kavē cietušā institūta noteikšana, jo normatīvais regulējums nenosaka saprātīgus termiņus, kurā persona var lūgt cietušā statusa piešķiršanu. Administratīvās lietas lēmuma paziņošanā, persona, kurai piešķirts cietušā status nesaņem lēmumu par lietas pabeigšanu, tādejādi pārkāpjot konstitūcijā noteiktās pamattiesības – tiesības uz informāciju.

The subject of the Bachelor's work, which the author will update, is “A road accident as a violation of road safety: their registration, consideration and decision-making.” The amount of work shall be 72 pages, including 6 annexes. Latvia is second in the world with the highest number of road traffic deaths caused by a road traffic accident. Statistics indicate that in the last four years, the number of fatalities related to road accidents has tended to decline, but the total number of road accidents in the country has increased in the last three years. Given that the total number of accidents is slightly but increasing, however, the number of accidents is not zero, with the result that this topic is important for society. Any unauthorized activity establishes a causal link between the CSNg caused and the damage to a person's property and health. This is a key prerequisite for the registration of CSNg and for the prosecution of a person who, through his unlawful acts, infringes the legitimate interests of another person by endangering the common road safety. The purpose of the study is to analyze the procedures for the taking and notification of the decision to register, examine and administrative violation of a road traffic accident, to identify problems and to develop amendments to the legal framework. Since a road traffic accident is a causal link to an administrative offence, administrative proceedings are initiated on the basis of the road traffic accident registration report. The author has found a lack of regulatory regulation at every stage of record keeping. At the registration stage of the CSNg, the terminology determined by the road traffic regulations does not allow the systematic interpretation method to correctly characterize the types of accident in accordance with the requirements of the normative acts, thus it is necessary to improve it. At the stage of the administrative proceedings, insufficient regulation prevents the records from being completed at the scene, thereby placing an additional burden on the institution and infringing the principle of procedural economy. The adoption of a decision of an administrative matter is impeded by the determination of the injured institution, because the regulatory framework does not prescribe reasonable time periods within which a person may request the granting of the injured status.

In notifying a decision of an administrative matter, a person who has been granted the status of a victim does not receive a decision regarding the termination of the matter, thereby violating the fundamental rights laid down in the constitution – the right to information.
