Vardarbībā cietuša bērna aizsardzības tiesiskais regulējums, tā piemērošana un attīstības perspektīvas

Abstract

Bakalaura darba tēma ir “Vardarbībā cietuša bērna aizsardzības tiesiskais regulējums, tā piemērošana un attīstības perspektīvas”. Bakalaura darba mērķis ir analizēt vardarbībā cietušu bērnu aizsardzības tiesisko regulējumu un tā piemērošanu, identificēt problemātiku un ieteikt tiesiskā regulējuma pilnveidošanas veidus. Bakalaura darbā izvirzītā mērķa sasniegšanai tiek veikti šādi uzdevumi: 1) izpētīt vardarbības veidus pret bērniem un atbildības par vardarbību pret bērniem tiesisko regulējumu, kā arī vardarbībā cietušu bērnu situāciju Latvijas Republikā; 2) analizēt vardarbībā cietuša bērna aizsardzības tiesisko regulējumu un tā piemērošanas īpatnības Latvijas Republikā; 3) analizēt vardarbībā cietuša bērna aizsardzības tiesiskā regulējuma attīstības perspektīvas un Bērna mājas izveidošanas modeli un tā izmantošanas iespējas. Bakalaura darbā ir izmantotas vairākas pētīšanas metodes: analītiskā pētnieciskā metode, deskriptīvā (aprakstošā) pētniecības metode, dedukcijas un indukcijas pētniecības metode, dogmatiskā un loģiski konstruktīvā pētniecības metode un tiesību normu iztulkošanas metodes: gramatiskā, teleoloģiskā, vēsturiskā un sistēmiskā interpretācijas metode. Bakalaura darba kopējais apjoms ir 66 lappuses. Bakalaura darbs satur 76 izmantotos literatūras avotus. Bakalaura darbs ir strukturēts trīs nodaļās ar apakšnodaļām. Darba pirmajā nodaļā ir sniegts vispusīgs vardarbības veidu pret bērniem un atbildības par vardarbību pret bērniem tiesiskā regulējuma raksturojums, kā arī analizēta vardarbībā cietušu bērnu situācija Latvijas Republikā. Darba otrajā nodaļā ir analizēts vardarbībā cietuša bērna aizsardzības tiesiskais regulējums un tā piemērošanas īpatnības un problēmas Latvijas Republikā. Darba trešajā nodaļā tiek analizētas vardarbībā cietuša bērna aizsardzības tiesiskā regulējuma attīstības perspektīvas un Bērna mājas izveidošanas modelis un izmantošanas iespējas Latvijas Republikā. Nobeigumā apkopoti galvenie secinājumi un izvirzīti priekšlikumi. The topic of the bachelor's thesis is “Legal regulation of the protection of a child victim of violence, its application and development perspectives”. The aim of the bachelor's thesis is to analyse the legal framework for the protection of abused children and its application, to identify problems and to recommend ways of improving the legal framework. In order to achieve the goal set in the bachelor thesis, the following tasks are carried out: 1) to study the types of violence against children and the legal regulation of responsibility for violence against children, as well as the situation of abused children in the Republic of Latvia; 2) to analyse the legal framework for the protection of a child victim of violence and the peculiarities of its application in the Republic of Latvia; 3) to analyse the development perspectives of the legal framework for the protection of a child victim of violence and the model of establishing the BarnaHus and the possibilities of its use. Several research methods are used in the bachelor's work: analytical research method, descriptive (descriptive) research method, deduction and induction research method, methods of dogmatic and logically constructive research and methods of interpreting legal norms: grammatical, teleological, historical and systemic interpretation method. The total volume of the bachelor thesis are 66 pages. The bachelor's thesis contains 76 used literary sources. The bachelor thesis is structured in three chapters with subsections. The first chapter of the work presents a comprehensive description of the legal framework of forms of violence against children and responsibility for violence against children, as well as analyses the situation of abused children in the Republic of Latvia. The second chapter of the paper analyses the legal regulation of the protection of a child victim of violence and the peculiarities and problems of its application in the Republic of Latvia. The third chapter of the paper analyses the development perspectives of the legal framework for the protection of abused children and the model of establishing the BarnaHus and the possibilities of its use in the Republic of Latvia. In the end, the main conclusions and proposed proposals are summarized.
