Ārzemnieku nodarbinātības tiesiskais regulējums

Abstract

Mūsdienās ne tikai LV, bet arī visā Eiropā palielinās imigrantu skaits, kuri ekonomisku, personīgo, politisko vai citu iemeslu dēļ apmetas uz dzīvi citā valstī, t.sk. arī LV. PMLP statistikas dati par izsniegtajām vīzām un UA pierāda to, ka ārzemnieku skaits palielinās un viens no iemesliem, kāpēc ārzemnieki izvēlas LV, ir nodarbinātība. Ārzemnieku nodarbinātību LV regulē vairāki normatīvie akti, kā: Līgums par ES darbību, Eiropas Parlamenta un Padomes regula (ES) Nr. 2016/399, Eiropas Parlamenta un Padomes direktīva Nr.2004/38/EK, Administratīvās atbildības likums, Imigrācijas likums, Darba likums, Darba aizsardzības likums, MK 28.01.2014. noteikumi Nr. 55, MK 30.08.2011. noteikumi Nr. 675, MK 21.06.2010. noteikumi Nr. 564, MK 10.03.2009. noteikumi Nr. 219, MK 25.02.2002. noteikumi Nr. 272, u.c. Pētījumā „Ārzemnieku nodarbinātības tiesiskais regulējums” ir raksturots LV pastāvošais tiesiskais regulējums ārzemnieku nodarbinātībai un no tā izrietošie problēmjautājumi. Lai atklātu pētījumā izvirzīto mērķi, tika analizēti vairāki aspekti – ārzemnieka nodarbinātības būtība, jēdzieni un attīstība, ārzemnieka tiesības, pienākumi, ieceļošanas un uzturēšanās nosacījumi saistībā ar nodarbinātību, ārzemnieku nodarbinātība LV. Minētie aspekti veido pētījuma struktūru, kur katram no aspektiem veltīta atsevišķa nodaļa. Temata aktualitāte pamatojama ar to, ka, analizējot spēkā esošos normatīvos aktus, iepriekš veiktos pētījumus, statistiku par izsniegtajām vīzām, UA, reģistrācijas un patstāvīgās uzturēšanās apliecībām, kā arī pieejamo tiesu praksi, LV ar katru gadu palielinās nodarbināto ārzemnieku skaits un LV ir pieejams plašs normatīvo aktu apjoms, kas regulē ārzemnieku nodarbinātību, bet tiesiskam regulējumam ir nepilnības un ir tiesiskā regulējuma piemērošanas problēmas, kas ir arī pētījuma juridiskās problēmas. Pētījuma mērķis ir, analizējot ārzemnieka nodarbinātības tiesisko regulējumu un tā piemērošanu, konstatēt problēmjautājumus un ieteikt to risinājumus. Darba apjoms: 63 lpp, 89 bibliogrāfijas avoti.

Nowadays, not only in Latvia, but also throughout Europe, the number of immigrants who settle in another country for economic, personal, political or other reasons is increasing, also in Latvia. Statistical data, provided by Office of Citizenship and Migration Affairs Re-public of Latvia, on issued visas and residence permits prove that the number of foreigners is increasing and one of the reasons why foreigners choose Latvia are employment. The employment of foreigners in Latvia is regulated by several regulatory acts, such as: The Treaty on the Functioning of the European Union, Regulation (EU) 2016/399 of the European Parliament and of the Council, Directive 2004/38/EC of the European Parliament and of the Council, Law on Administrative Liability, Immigration Law, Labour Law, Labour Protection Law, Republic of Latvia Cabinet Regulation No. 55 adopted 28 January 2014, Re-public of Latvia Cabinet Regulation No. 675 adopted 30 August 2011, Republic of Latvia Cabinet Regulation No. 564 adopted 21 June 2010, Republic of Latvia Cabinet Regulation No. 219 adopted 10 March 2009, Republic of Latvia Cabinet Regulation No. 272 adopted 25 February 2002 and others. In the study “Legal regulation of foreigner’s employment” has been described the ex-isting legal framework for the employment of foreigners in Latvia and the problematic issues arising from it. In order to discover the goal set in the study, several aspects were analyzed - the nature, concepts and development of foreigner's employment, foreigner's rights, obliga-tions, conditions of entry and stay in relation to employment, employment of foreigners in Latvia. The mentioned aspects form the structure of the study, where a separate chapter is de-voted to each aspect. The topicality of the topic is justified by the fact that, when analyzing the current legal acts, previously conducted research, statistics on issued visas, residence permits, registration and independent maintenance certificates, as well as the available court practice, the number of foreigners employed in Latvia increases every year and Latvia has access to a wide range of regulatory acts that regulate the employment of foreigners, but the legal framework has gaps and there are problems of applying the legal framework, which are also the legal problems of the study. The aim of the study is to identify problematic issues and recommend solutions by an-alyzing the legal regulation of the employment of foreigners and its application.
