Administratīvā pārkāpuma process par elektroskrejriteņa vadīšanu apreibinošo vielu ietekmē

Abstract

Bakalaura darba tēma ir „Administratīvā pārkāpuma process par elektroskrejriteņa vadīšanu apreibinošo vielu ietekmē.” Attīstoties tehnoloģijām un inovācijām, kā arī izvēloties videi draudzīgākus transportlīdzekļus, pilsētvidē arvien biežāk parādās elektroskrejriteņi. Vienlaikus pieaug ceļu satiksmes negadījumu un tajos cietušo personu skaits. Viens no biežākajiem administratīvajiem pārkāpumiem ceļu satiksmē ir transportlīdzekļa vadīšana apreibinošo vielu iespaidā. Ar mērķi uzlabot satiksmes drošību, 2021. gadā Ceļu satiksmes likumā un Ceļu satiksmes noteikumos tika izdarīti grozījumi, ar ko Latvijā tika atļauta elektroskrejriteņu dalība ceļu satiksmē. Bakalaura darba mērķis ir analizēt administratīvā pārkāpuma procesu par elektroskrejriteņa vadīšanu apreibinošo vielu ietekmē un noskaidrot problēmjautājumus, lai izvirzītu priekšlikumus tiesiskā regulējuma un prakses pilnveidošanai. Pētījuma gaitā tika secināts, ka normatīvajos aktos nepieciešami precizējumi, tai skaitā, jāprecizē jēdziens „elektroskrejritenis”. Pētījumā tāpat tika secināts, ka nepieciešams pastiprināt atbldību par elektroskrejriteņa vadīšanu alkohola vai citu apreibinošo vielu ietekmē. Par lietderīgu tika atzīta pārkāpumu uzskaites punktu sistēmas piemērošana elektroskrejriteņu vadītājiem, kā arī tika secināts, ka elektroskrejriteņi būtu obligāti reģistrējami un to vadītajiem, lai varētu piedalīties ceļu satiksmē, būtu jābūt vismaz velosipēda vadītāja apliecībai. Pētījumā tika izmantoti Latvijas tiesību akti, juridiskā literatūra un periodika, interneta resursi, pētījumi un statistikas dati. Pētījuma gaitā, ar mērķi uzlabot ceļu satiksmes drošību, tika izstrādāti priekšlikumi grozījumiem normatīvajos aktos. Pētījumā ir 68 lappuses.

The subject of the bachelor's thesis is “Administrative violation process for driving an electric scooter under the influence of intoxicating substances”. With the development of technologies and innovations, as well as with the choice for more environmentally friendly vehicles, electric scooters are increasingly appearing in the urban environment. At the same time, the number of traffic accidents and victims is increasing. One of the most frequent administrative offenses is driving a vehicle under the influence of intoxicating substances. With the aim of improving traffic safety, in 2021 amendments were adopted to the Road Traffic Law and Road Traffic Regulations, allowing electric scooters in road traffic of Latvia. The aim of the bachelor's thesis is to analyze the administrative offense proceedings for driving an electric scooter under the influence of intoxicating substances and clarify the problematic issues in order to put forward proposals for the improvement of legal regulations and practice. In the course of the research, it was concluded that clarifications are needed in the regulatory acts, including the definition of the term “electric scooter”. It is also concluded that it is necessary to increase responsibility for driving an electric scooter under the influence of alcohol or other intoxicating substances. The application of the offense points’ system for drivers of electric scooters was recognized as useful, and it was also concluded that electric scooters should be registered and their drivers should have at least a bicycle driver's license in order to be able to participate in road traffic. Latvian legal regulations, legal literature and periodicals, Internet resources, research and statistical data were used in the research. In the course of this research, with the aim of improving road traffic safety, proposals for amendments to regulatory acts were worked out. The study has 68 pages.
