Nodarbinātības digitālajās darba platformās tiesiskie aspekti

Abstract

Maģistra darba “Nodarbinātības digitālajās darba platformās tiesiskie aspekti” mērķis bija izpētīt digitālo darba platformu un personu, kas veic platformu darbu, tiesiskās attiecībās un piemērojamo tiesisko regulējumu, kā arī, izpētot praksē pastāvošos platformas darba veicēju nodarbinātības statusus, sniegt priekšlikumus normatīvo aktu pilnveidei, kas izriet no konstatētajiem ar nodarbinātību digitālajās darba platformās saistītiem problēmjautājumiem. Maģistra darba tēmas aktualitāte pamatota ar to, ka šobrīd pastāv juridiska nenoteiktība un viedokļu atšķirība par to, kādas tiesiskās attiecības ir nodibināmas starp digitālajām darba platformām un platformas darba veicējiem. Arvien aktuālāki kļūst līdz šim tiesiski neskaidri regulēti jautājumi par digitālo darba platformu juridiskajiem statusiem pret platformas darba veicējiem, to pienākumiem un atbildību pret šīm personām, kā arī platformas darba veicēju nodarbinātības statusu atbilstoša klasifikāciju. Maģistra darbs tika izstrādāts piecās nodaļās un piecās apakšnodaļās. Izpētot, kas ir digitālās darba platformas un kā tiek veikts platformas darbs, kādas tiesiskās attiecības pastāv starp digitālajām darba platformām un platformas darba veicējiem, un kāds tiesiskais regulējums tām ir saistošs, kā arī, analizējot ar platformu darbu saistītu tiesu praksi, konstatēti nodarbinātības digitālajās darba platformās tiesiskie aspekti un problemātika. Maģistra darba kopējais apjoms ir 84 lappuses.

The goal of the master's thesis “Legal aspects of the employment in digital labour platforms” was to study the legal relations and applicable legal framework of the digital labour platform and the persons performing the work, as well as to provide proposals for the improvement of regulatory enactments, arising from the problems identified with employment on digital labour platforms. The relevancy of the topic of the master's thesis is based on the fact, that there is currently legal uncertainty and a difference of opinion on the legal relationship to be established between digital labour platforms and platform workers. Legally unclear issues regarding the legal status of digital labour platforms towards the platform's employees, their duties and responsibilities towards these persons, as well as the appropriate classification of the platform's employment status is also getting more relevant. The master’s thesis was made containing five chapters and five subsections. The legal aspects and problems of employment in digital labour platforms have been identified by researching what are digital labour platforms, how the work is done in them, the legal relationship between the digital labour platforms and the operators of the platform and the legal framework binding on them, as well as an analysis of the case law related to the work of the platforms. The total volume of the master's thesis is 84 pages.
