Pacientu tiesību nodrošināšanas tiesiskie aspekti attālināto veselības aprūpes pakalpojumu sniegšanā

Abstract

Medicīnas nozarei pēdējos gadus ir bijis izaicinājumiem bagāts laiks, COVID-19 pandēmija spilgti izgaismoja tās problemātiku, kuru nācās risināt nekavējoties. Lai nodrošinātu nepārtrauktu veselības aprūpes pakalpojuma sniegšanu, bija nepieciešams meklēt risinājumus attālinātai pakalpojuma sniegšanai, ierobežojot bīstamā vīrusa izplatību, kā arī turpinot sniegt nepārtrauktu atbalstu pacientiem. Šī Bakalaura darba struktūra sastāv no ievada, trīs nodaļām un to apakšnodaļām, un nobeigumu. Ievadā tiek uzsvērta tēmas aktualitāte, definēta pētāmā problēma, tiek izvirzīti mērķi un noteikti darba uzdevumi, tiek izvirzīti darbā pētāmie jautājumi, kā arī noteiktas izmantotās metodes darba izstrādes laikā. Pirmajā nodaļā tiek pētīts attālinātas veselības aprūpes jēdziens un būtība, kā arī tiek pētīts starptautiskais regulējums un attālinātas veselības aprūpes tiesiskais kopums Latvijā. Bakalaura darba otrajā nodaļā tiek analizēts pacientu tiesību realizācija attālinātas veselības aprūpes kontekstā, izskatot pacienta tiesības uz informāciju, tā tiesības uz veselības aprūpi un informēta piekrišana attālināto veselības aprūpes pakalpojuma kontekstā. Un darba trešajā nodaļā tiek pētīta problemātika un riski attālinātas veselības aprūpes sniegšanā no pacientu tiesību nodrošināšanas aspekta, kā arī ārstniecības personu tiesiskā rakstura izaicinājumi sniedzot attālinātus veselības aprūpes pakalpojumus. Bakalaura darba nobeigumā tiek izklāstīti secinājumi, kuri gūti darba izstrādes laikā, kā arī piedāvājums normatīvo aktu regulējuma pilnveidošanai. Bakalaura darba mērķis ir izpētīt un izanalizēt šī brīža tiesisko regulējumu pacientu tiesību jomā, saņemot attālinātu veselības aprūpes pakalpojumu, kā arī izteikt priekšlikumus tiesiskā regulējuma pilnveidošanai. Kā problemātika tika noteikta normatīvo aktu regulējuma neesamība attālinātas aprūpes pakalpojuma sniegšanas jomā un konstatētās pretrunas jau esošajā regulējumā. Bakalaura darbs sastāv no 56 lapām.

The medical industry has had a challenging time in recent years, and the COVID-19 pandemic has highlighted its immediate challenges. In order to ensure the continuous provision of health care, it was necessary to look for solutions for the remote provision of the service, limiting the spread of the dangerous virus, as well as continuing to provide continuous support to patients. The structure of this bachelor’s thesis consists of an introduction, three chapters and their subsections, and a conclusion. In the introduction, the topicality of the topic is emphasized, the research problem is defined, the goals and tasks of the work are set, the research questions are set, as well as the methods used during the development of the work are determined. The first chapter examines the concept and essence of remote health care in the context of ensuring patients' rights, as well as the international regulation and the legal framework of remote health care in Latvia. The second chapter of the bachelor's thesis analyzes the realization of patients' rights in the context of remote health care, considering the patient's right to information, his right to health care and informed consent in the context of remote health care service. And in the third chapter, the problems, and risks in the provision of remote healthcare are studied from the aspect of ensuring patients' rights, as well as the challenges of the legal nature of medical personnel when providing remote health care services. At the end of the bachelor's thesis, the conclusions obtained during the elaboration of the thesis are presented, as well as an offer for the improvement of the regulatory enactments. The aim of the bachelor's thesis is to study and analyze the current legal framework in the field of patients' rights when receiving remote health care services, as well as to make proposals for the improvement of the legal framework. The lack of regulation of regulatory enactments in the field of provision of remote care services and the identified contradictions in the existing regulation were identified as problems. The bachelor's thesis consists of 56 pages.
