Dzīvesvietas deklarēšanas tiesiskā nozīme un ietekme uz personas tiesībām

Abstract

Bakalaura darba tēma ir “Dzīvesvietas deklarēšanas tiesiskā nozīme un ietekme uz personas tiesībām”. Pētījuma darba mērķis ir izpētīt dzīvesvietas deklarēšanas tiesisko nozīmi, tās regulējumu un ietekmi uz personas tiesībām, veicot juridisko problēmu konstatēšanu un izvirzot priekšlikumus tiesiskā regulējuma pilnveidošanai. Informācija par personas deklarēto dzīvesvietu ir būtiska ne tikai valsts vai pašvaldības iespējai sazināties ar personu, bet arī dažādu procesu nodrošināšanai, piemēram, konkrētās pašvaldības iedzīvotāju skaita noteikšanā, personas iespējai piedalīties attiecīgās pašvaldības vēlēšanās vai dažādu balstiesību saņemšanai pašvaldībā, nosakot personas ienākumu nodokļu daļu, nosakot personas pabalsta apjomu, piemērojot dažādus maksājumu procentus, kā arī daudzās citās būtiskās darbībās, kas ietekmē personu un tās tiesības. Darba gaitā tiks izmantots dažādu avotu un literatūras klāsts – Eiropas Parlamenta un Padomes Regula, Dzīvesvietas deklarēšanas likums, Civillikums, Civilprocesa likums, Diasporas likums, Administratīvās atbildības likums, Paziņošanas likums, Ministru kabineta noteikumi, tiesu spriedumi, likumprojektu grozījumi, kā arī periodikas izdevumu avoti un citi elektronisko resursu avoti. Darba gaitā tiek sniegtas atbildes uz jautājumiem par to kā mērķis, kuru vēlējās sasniegt likumdevējs ar tiesību normas regulējumu dzīvesvietas deklarēšanas nepieciešamībai darbojas praksē, kā dzīvesvietas deklarēšanas nepieciešamība ietekmē personu tiesības un kādi uzlabojumi varētu sekmēt pilnvērtīgu valsts un to iestāžu sasniedzamību ar personām.

The topic of the bachelor's thesis is "The legal significance and impact of the declaration of residence on the rights of individuals". The purpose of the research work is the legal significance of the declaration of residence, its regulation and impact on the rights of individuals, by identifying legal problems and putting forward a proposal for improving the legal framework. Information about a person's declared place of residence is essential not only for the possibility of the state or municipality to contact the person, but also for the provision of various processes, for example, determining the number of residents of the specific municipality, the possibility of a person to participate in the elections of the relevant municipality or to receive various voting rights in the municipality, determining the tax share of a person's income, determining the amount of a person's benefit, applying different payment percentages, as well as in many other important actions that affect the person and his rights. A range of different sources and literature will be used in the course of the work - Regulation of the European Parliament and Council, Law on Declaration of Residence, Civil Law, Civil Procedure Law, Diaspora Law, Administrative Responsibility Law, Notification Law, Cabinet of Ministers Regulations, court rulings, amendments to draft laws, as well as sources of periodicals and other sources of electronic resources. In the course of the work, answers are given to questions about how the goal that the legislator wanted to achieve with the regulation of the legal norm for the need to declare the place of residence works in practice, how the need to declare the place of residence affects the rights of individuals and what improvements could contribute to the full accessibility of the state and its institutions to individuals.
