Piedziņas vēršana uz parādnieka naudas līdzekļiem

Abstract

Bakalaura darba tēma ir “Piedziņas vēršana uz parādnieka naudas līdzekļiem”. Tēmas aktualitāte saistīta ar to, ka, piedziņas vēršana uz parādnieka naudas līdzekļiem ir viens no populārākajiem piespiedu piedziņas veidiem. Tie sevī iekļauj piedziņas vēršanu uz parādnieka naudas līdzekļiem kredītiestādē, no citām personām, kā arī uz darba samaksas ieturējumiem un tai pielīdzinātajiem maksājumiem. Bakalaura darbā “Piedziņas vēršana uz parādnieka naudas līdzekļiem” ir analizēti dažādi aktuāli jautājumi sakarā ar ieturējumu veikšanu no parādnieka kredītiestāžu kontiem, par Valsts ieņēmuma dienesta parādnieku pārmaksāto nodokļu pārskaitīšanu tiesu izpildītāja depozīta kontā, rīkojumu izpildi no darba devēja puses, kā arī citiem. Autore darbā arī sniegs savu redzējumu problēmsituāciju risināšanā. Bakalaura darba mērķis - izpētot piedziņas procesa tiesisko regulējumu, izzināt tā problemātiku, un izstrādāt ieteikumus piedziņas vēršanas uz naudas līdzekļiem normatīvo aktu pilnveidi, kā arī esošo normu vienveidīgai izpratnei. Bakalaurs sastāv no trīs nodaļām un tā apjoms ir 53.lpp. Atslēgvārdi: piespiedu izpildes līdzekļi, piespiedu piedziņa, tiesu izpildītājs, parādnieks, naudas līdzekļi.

The theme of the study is „Recovery of the debtor's funds in the enforcement proceeding”. The subject's spotlight relates to the fact that turning a recovery to a debtor's coffers is one of the most popular forms of forced recovery. They shall include turning the recovery to the debtor's funds in the credit institution, from other persons, as well as to deductions for remuneration and the equivalent payments. The theme „Recovery of the debtor's funds in the enforcement proceeding”, various topical issues have been analysed in relation to the performance of deductions from the accounts of the debtor's credit institutions, the transfer of overpaid taxes of debtors of the State Revenue Service to the deposit account of the bailiff, the execution of orders from the employer's side, as well as others. The author at work will also give her vision for tackling the problems. The objective of the work of the Bachelor - to explore the legal framework for the recovery process, to investigate its problems, and to develop recommendations for improving the regulatory enactments for the recovery of funds, as well as for the uniform understanding of existing standards.
