Pacientu prioritizēšanas tiesiskie aspekti nacionālajā tiesību sistēmā

Abstract

Bakalaura darba tēma ir „Pacientu prioritizēšanas tiesiskie aspekti nacionālajā tiesību sistēmā”. Tēmas aktualitāti nosaka tas, ka Covid-19 pandēmija aktualizēja jautājumu par pacientu prioritizēšanu. Lai gan pacientu „šķirošana” notiek arī nepastāvot ārkārtas situācijai, Covid-19 pandēmija problēmas medicīnas nozarē tikai padarīja acīmredzamākas un pacientiem jūtamākas. Ņemot vērā problēmas ārstniecības jomā, būtiski izvērtēt, vai tiesiskais regulējums pacientu prioritēšanā nepakļaujas atšķirīgai interpretācijai un nepamatoti neierobežo pacientu tiesības. Tāpēc ārstniecības tiesiskā regulējuma izpēte ir būtiska tiesiskā regulējuma problēmu apzināšanai un identificēšanai, kā arī priekšlikumu izstrādāšanai problēmu novēršanai. Bakalaura darba mērķis ir analizējot pacientu prioritēšanas tiesiskos aspektus nacionālajā tiesību sistēmā un konstatējot iespējamās tiesiskās problēmas, sniegt priekšlikumus ārstnieciskā tiesiskā regulējuma pilnveidošanai. Pētījuma jautājumi: Kādas tiesību normas regulē pacientu tiesības uz veselības aprūpi? Kā notiek pacientu prioritēšana atkarībā no apstākļiem, kad prioritēšana tiek veikta? Kādi ir tiesību aizsardzības līdzekļi pamattiesību aizsardzībai? Pētījuma bāze: Bakalaura darbā autors analizēs un pētīs starptautisko un nacionālo normatīvo regulējumu, publiski pieejamās publikācijas no nozaru speciālistiem. Pētījumā normatīvā bāze ir ārstniecības regulējošas nacionālās un starptautiskās tiesību normas. Atslēgas vārdi ir pacientu tiesības, pacientu prioritēšana, pacientu šķirošana, ārstniecība. Darba apjoms ir 59 lapas. Darbs veidots no trijām nodaļām, ievada, secinājumiem un priekšlikumiem, izmantojot 74 literatūras avotus.

The topic of the bachelor thesis is "Legal aspects of patient prioritization in the national legal system". The topicality of the topic is determined by the fact that the Covid-19 pandemic raised the issue of prioritizing patients. Although the "sorting" of patients takes place even in the absence of an emergency situation, the Covid-19 pandemic only made the problems in the medical sector more obvious and felt by the patients. Taking into account the problems in the field of medical treatment, it is essential to evaluate whether the legal framework in prioritizing patients is not subject to a different interpretation and does not unreasonably limit the rights of patients. Therefore, the study of the legal framework of medical treatment is essential for the recognition and identification of legal framework problems, as well as for the development of proposals for the elimination of problems. The aim of the bachelor's thesis is to provide proposals for improving the medical legal framework by analyzing the legal aspects of patient prioritization in the national legal system and identifying possible legal problems. Research questions: What legal norms regulate patients' rights to health care? How is patient prioritization performed depending on the circumstances in which the prioritization is performed? What are the legal remedies for the protection of fundamental rights? Research basis: In the bachelor thesis, the author will analyze and study the international and national regulatory framework, publicly available publications from industry specialists. In the study, the regulatory basis is national and international legal norms regulating medical treatment. Key words are patients' rights, prioritization of patients, classification of patients, treatment. The work is 59 pages. The work consists of three chapters, introduction, conclusions and proposals, using 74 literary sources.
