Nosacītas notiesāšanas piemērošanas nosacījumu izvērtēšana

Abstract

Bakalaura darba nosaukums ir “Nosacītas notiesāšanas piemērošanas nosacījumu izvērtēšana”, darbā tiek pētīts nosacītas notiesāšanas piemērošanas nosacījumi, nosacītas notiesāšanas institūta attīstība, izpilde un uzraudzība, pārbaudes laika termiņš, kā arī nosacītas notiesāšanas regulējums citās Eiropas Savienības dalībvalstīs.

Temata aktualitāte pamatojama atšķirīgo tiesu praksi piemērojot nosacītu notiesāšanu, kā arī vairākiem citiem problēmjautājumiem, kas saistīti ar nosacītas notiesāšanas institūtu. Tiesas ne tikai dažādi interpretē Krimināllikuma 55.pantā ietvertos nosacītas notiesāšanas piemērošanas kritērijus, bet arī atšķiras motīvi kuru dēļ tiesa lemj par brīvības atņemšanas soda noteikšanu nosacīti. Būtiski, ka nemotivēts spriedums var kalpot par pamatu tā pārsūdzēšanai un atcelšanai.

Bakalaura darba mērķis ir analizēt nosacītas notiesāšanas piemērošanas nosacījumus un ar nosacītas notiesāšanas institūtu saistītās tiesiskā regulējuma problēmas, un sniegt priekšlikumus tiesiskās regulējuma uzlabošanai. Bakalaura dаrbа οbјеkts: krimināltiesiskās attiecības, kas rodas starp valsti un apsūdzēto, kam piemērojama nosacīta notiesāšana. Bakalaura dаrbа рriеkšmеts: tiesību avoti, kas regulē nosacītas notiesāšanas institūtu, tā piemērošanas nosacījumus un izpildi.

Darba iztirzājuma daļa sadalīta trīs nodaļās, kā arī vairākās apakšnodaļās, svarīgākos secinājumus un atziņas apkopojot darba nobeigumā. Darbs sastāv no 61 lapas.

The title of the bachelor's thesis is "Evaluation of the conditions for the application of a conditional sentence", and it explores the conditions, development, implementation, and supervision of this sentence, the term of probation, and the regulations of conditional sentencing effective in other EU member states.

The topicality of the topic is related to the different judicial practices in applying conditional sentences, and to several other problematic issues related to the institute of conditional sentencing. Not only do the courts interpret differently the criteria for the application of a conditional sentence defined in Article 55 of the Criminal Law, but also the motives for which the court decides to impose a conditional sentence of imprisonment differ. Importantly, an unmotivated judgment can serve as a basis for its appeal and cancellation.

The aim of the bachelor's thesis is to analyse the conditions for the application of a conditional sentence and the problems of the legal framework related to the institute of conditional sentencing and to provide proposals for improving the legal framework. The object of the bachelor's thesis: criminal legal relations arising from the application of a conditional sentence. The subject of the bachelor's thesis: sources of law that regulate the institute of conditional sentencing, its application and implementation.

The discussion part of the thesis is divided into 3 chapters and several subsections with the most important conclusions and findings being summarized at the end of the work. The thesis consists of 61 pages.
