Karavīra glābēja tiesiskā statusa nepilnības Latvijas Republikas tiesību tvērumā

Abstract

Bakalaura darbs “Karavīra glābēja tiesiskā stausa nepilnības Latvijas Republikas tiesību tvērumā” ir veltīts tiesību aktu, kuri regulē karavīra glābēja tiesiskā statusa izpētei. Darbā tiks pētīti vairāki tiesību akti, kā piemēram, Latvijas Republikas Satversme, Ārstniecības likums, Izglītības likums, to vēsturiskā izcelšanās un likumdevēja nodoms, pieņemot konkrēto tiesisko regulējumu, kā arī dažādi iekšējie normatīvie akti, kuri nosaka karavīru un zemessargu paplašinātās pirmās palīdzības mācību kursa programmu. Papildus iekšējiem normatīvajiem aktiem, autors pētīja arī Amerikas Savienoto Valstu (turpmāk tekstā ASV) mediķu asociāciju izdotos nolikumus, kā arī ASV Bruņoto spēku iekšējos normatīvos aktus, kuri regulē Tactical Combat Casualty Care (TCCC – Taktiskā kaujā cietušo medicīniskā aprūpe) norisi. Karavīra glābēja tiesiskais statuss Latvijas Republikas tiesību tvērumā ir definēts vairākos tiesību aktos, taču analizējot Ārstniecības likumu, Nacionālo Bruņoto Spēku normatīvos aktus, kuri nosaka kas ir ārstniecības persona, kāds ir karavīra glābēja tiesiskais statuss, kā arī ASV mediķu asociācijas nolikumu, kas nosaka TCCC apguves prasības un kritērijus, darba autors uzskata, ka tieši karavīra glābēja tiesiskais statuss ir nepilnīgs. Bakalaura darbs sastāv no ievada, trim nodaļām, nobeiguma, literatūras un avotu saraksta. Bakalaura darba noslēgumā autors izdara secinājumus par atsevišķu tiesību avotu nepilnībām, tiesību normu dažādu interpretēšanu, kā arī izvirza ieteikumus tiesiskā regulējuma uzlabošanai. Bakalaura darba apjoms ir 61 lappuse, izmantoti 41 informācijas avoti.

The bachelor's thesis "Imperfections of the legal status of a soldier's rescuer in the scope of the law of the Republic of Latvia" is devoted to the study of legal acts that regulate the legal status of a soldier's rescuer. The work will study several legal acts, such as the Constitution of the Republic of Latvia, the Medical Law, the Education Law, their historical origin and the intention of the legislator, adopting the specific legal regulation, as well as various internal regulatory acts that determine the first aid training course program for soldiers and national guardsmen. In addition to internal regulations, the author also studied the regulations issued by medical associations of the United States of America, as well as the internal regulations of the US Armed Forces, which regulate the conduct of Tactical Combat Casualty Care. The legal status of a soldier's rescuer in the scope of the law of the Republic of Latvia is defined in several legal acts, but when analyzing the Medical Treatment Law, the regulations of the National Armed Forces which define who is a medical person, what is the legal status of a soldier's rescuer, as well as the US medical associations regulations, which determine the requirements and criteria for TCCC learning, the author of the paper believes that the fact of non-equalization of the education of a soldier rescuer is legally incomplete in relation to the soldier rescuer. The bachelor's thesis consists of an introduction, three chapters, a conclusion, literature and a list of sources. At the end of the bachelor's thesis, the author draws conclusions about the shortcomings of individual sources of law, different interpretations of legal norms, as well as puts forward recommendations for improving the legal framework. The volume of the bachelor's thesis is 61 pages, 41 sources of information are used.
