Medicīniskās apaugļošanas: nacionālais un starptautiskais tiesiskais regulējums un tā problemātika

Abstract

Bakalaura darba temats ir medicīniskās apaugļošanas: nacionālais un starptautiskais tiesiskais regulējums un tā problemātika. Mērķis ir, izpētot medicīniskās apaugļošanas tiesisko regulējumu un tiesu praksi, apzināt problēmas tiesiskajā regulējumā un sniegt risinājumu. Temats ir aktuāls, jo neauglība tiek uzskatīta par reproduktīvās veselības globālu veselības problēmu, kas skar vairākus miljonus cilvēku visā pasaulē, tai skaitā arī Latvijā. Medicīniskā apaugļošana ir viens no veidiem, kā neauglīgiem pāriem tikt pie bērna izmantojot medicīnas zinātnes un tehnoloģiju attīstību. Līdz ar zinātnes un tehnoloģiju attīstību arī likumdevējam ir jāseko līdzi un jāpilnveido tiesību normas, kas regulē medicīnisko apaugļošanu, tādā veidā novēršot normu nepilnības un interpretācijas kļūdas. Bakalaura darbs sastāv no ievada un trim nodaļām, kā arī vairākām apakšnodaļām. Bakalaura darba pirmajā nodaļā tiek pētīts medicīniskās apaugļošanas tiesiskais regulējums, kas sadalīts vairākās apakšnodaļās. Pirmajā apakšnodaļā tiek pētīts tiesiskais regulējums Latvijas Republikā, otrajā apakšnodaļā tiek pētīts tiesiskais regulējums citās Eiropas Savienības dalībvalstīs un trešajā apakšnodaļā tiek pētīts tiesiskais regulējums cilvēktiesību jomā. Darba otrā nodaļa ir veltīta tiesu prakses analīzei, pirmajā apakšnodaļā tiek pētīta Latvijas Republikas tiesu prakse, otrajā apakšnodaļā tiek pētīta tiesu prakse, ko sniegusi Eiropas Cilvēktiesību tiesa. Savukārt darba trešā nodaļa ir veltīta medicīniskās apaugļošanas tiesiskā regulējuma novērtējumam un analīzei, kā arī sniegts tā risinājums.

The subject of bachelor’s thesis is medically assisted insemination: national and international legal regulation and its problematic. The aim of bachelor’s thesis is to identify the problems in the legal framework and provide a solution by studying the legal framework and court practice of artificial insemination. The topic is relevant because infertility is considered a global health problem of reproductive health that affects several million individuals worldwide. Artificial insemination is one of the ways for infertile couples to have a child using the development of medical science and technology. The legislator must monitor and improve the legal norms that regulate artificial insemination, thus eliminating gaps in the norms and errors in interpretations. The Bachelor’s thesis consists of an introduction and three chapters and several subsections. The first chapter of the Bachelor’s thesis looks at the legal regulation of medical insemination and it is divided into several subsections. The first subsection examines the legal regulation in the Republic of Latvia, the second subsection examines the legal regulation in the other European Union member states, and the third subsection examines the legal regulation in the field of human rights. The second chapter of the Bachelor’s thesis is devoted to the analysis of judicial practice, the first subsection will analyse the judicial practice in Republic of Latvia courts, while the second subsection is devoted to the analysis of the judicial practice by European Human Rights court. The third chapter of the Bachelor’s thesis is devoted to the evaluation and analysis of the legal regulation of medical insemination and provides its solution.
