Attālinātā darba tiesiskais regulējums un ar to saistītie problēmjautājumi

Abstract

Šī pētījuma temats ir “Attālinātā darba tiesiskais regulējums un ar to saistītie problēmjautājumi”. Nesenās Covid-19 pandēmijas ietekmē neparedzēti aktualizējās temats par darbinieku tiesībām uz attālināto darbu, tā organizāciju, darba vides aizsardzību un citiem jautājumiem, kas saistīti ar strādāšanu attālināti. Kaut arī Latvijā šāds darba veids nebija visai aktuāls līdz pandēmijas laikam, autors uzskata, ka pēc pandēmijas tas nostiprināsies un pastāvīgi paliks par neatņemamu darba tiesību sastāvdaļu. Bakalaura darba mērķis ir izpētīt ar attālināto darbu saistīto tiesisko regulējumu, noskaidrot tā galvenos problēmjautājumus, kā arī, ja iespējams, piedāvāt jaunus risinājumus normatīvo aktu pilnveidošanai. Pētījuma gaitā autors atklāja dažādas nepilnības Latvijas normatīvo aktu regulējumā, kas galvenokārt saistītas ar neprecīzi skaidrotu attālinātā darba definīciju un neefektīvu regulējumu darba vides risku novēršanai. Neprecīza termina definīcija paver iespējas manipulēt ar attālināti strādājošā statusu, kas, savukārt, var nelabvēlīgi ietekmēt darbinieka tiesisko stāvokli. Attiecībā uz darba vides risku novēršanu tika atklāta problemātika ne vien normatīvo aktu regulējumā, bet arī darbinieku aizsardzības organizēšanas sistēmā. Bakalaura darbu veido 60 lappuses, un tas ir sadalīts trīs virsnodaļās ar apakšnodaļām. Nodaļās tiek aplūkoti tādi jautājumi kā attālinātā darba jēdziens, vēsture un nozīme mūsdienās, attālinātā darba tiesiskais regulējums Latvijā, kā arī darba vides drošības tiesiskais regulējums attiecībā uz attālināto darbu. The topic of this study is "The legal framework for teleworking and related issues". The The recent Covid-19 pandemic has suddenly raised the issue of workers' rights to telework, its the organisation, protection of the working environment and other issues related to teleworking. Although this type of work was not very popular in Latvia before the pandemic, the author believes that after the pandemic it will become more established and will forever remain an integral part of labour law. The aim of the bachelor thesis is to study the legal framework related to remote working, to identify its main issues and, if possible, to propose new solutions to improve the legal framework. In the course of the research, the author identified various shortcomings in the Latvian regulatory framework, mainly related to an imprecise definition of remote working and ineffective regulation to prevent risks in the working environment. An imprecise definition of the term opens up opportunities for manipulation of the status of a remote worker, which in turn may adversely affect the employee's legal position. As regards the prevention of risks to the working environment, problems were identified not only in the regulatory framework, but also in the system of organising the protection of workers. The bachelor thesis consists of 60 pages and is divided into three chapters with sub chapters. The chapters deal with issues such as the concept, history and significance of teleworking today, the legal regulation of teleworking in Latvia, as well as the legal regulation of safety in the working environment in relation to teleworking.
