Poligrāfa ekspertīzes eksperta atzinums kā pierādījums kriminālprocesā

Abstract

Maģistra darbs “Poligrāfa ekspertīzes eksperta atzinums kā pierādījums kriminālprocesā” aktualitāte saistītā ar to, ka pētnieku un praktizējošo juristu vidū pastāv domstarpības par poligrāfa ekspertīzes izmantošanu pierādīšanā. Temata aktualitātes juridiskais konteksts ir saistīts ar nepilnībām tiesiskajā regulējumā, piemēram, nepastāv tiesību normas, kas nosaka, ka šādas ekspertīzes veicamas tikai ar subjekta brīvprātīgu piekrišanu. Ņemot vērā 2016.gada 20.decembra Ministru kabineta noteikumus Nr. 835 “Noteikumi par tiesu ekspertīžu iestāžu sarakstu un tiesu ekspertu specialitāšu klasifikatoru”, saskaņā ar kuriem pshodiagnostiskā poligrāfa ekspertīze ir viens no tiesu ekspertīžu veidiem, arī poligrāfa ekspertīzes eksperta atzinums var būt par pierādījumu kriminālprocesā. Poligrāfa ekspertīzes eksperta atzinumu kā pierādījuma izmantošanai kriminālprocesā ir šādi priekšnosacījumi: ekspertīzes veicēja atbilstošā kompetence, Kriminālprocesa likumā norādīto šķēršļu neesamība, kas neatļauj konkrētai personai kā ekspertam veikt ekspertīzi, zinātniski atzītu metožu izmantošana pētījumā, eksperta atzinuma pamatotība, subjekta brīvprātīga piekrišana, subjekta veselības stāvokļa izvērtēšana pirms izpētes. Darba autore izstrādāja priekšlikumus tiesiskā regulējuma pilnveidei pētāmā temata jomā. Maģistra darbs sastāv no 95 lapām. The topicality of the Master's thesis “Polygraph Expert Opinion as evidence in Criminal proceedings” is related to the fact that there is disagreement among researchers and legal practitioners regarding the use of the Polygraph Expert-examination in evidence. The legal context of the current issue is linked to shortcomings in the legal framework, such as the absence of legal provisions requiring such expertise to be carried out only with the voluntary consent of the subject. Taking into Cabinet of Ministers Regulation No. 835 of 20 December 2016, Regulations regarding List of Forensic Expert-examination institutions and Classification of specialities of Forensic experts, according to which the Pshodiagnostical Polygraph Expert examination is one of the types of Forensic Expert-examination, the opinion of the Polygraph Expert-examination Expert may also be evidence in criminal proceedings. The following conditions shall be fulfilled for the use of an expert opinion of a polygraph expert-examination as evidence in criminal proceedings: the relevant competence of the performer of the expert examination, the absence of obstacles indicated in the Criminal Procedure Law, which do not allow a specific person as an expert to perform an expert-examination, the use of scientifically recognised methods in the research, the validity of the expert opinion, the voluntary consent of the subject, the evaluation of the health condition of the subject prior to the research. The author of the Master's thesis made proposals to improve the legal framework in the field of research. The Master's thesis consists of 95 pages.
