Atbalsts ģimenēm ar bērniem, kurās vecāki pilda valsts aizsardzības uzdevumu kara, militāra iebrukuma vai draudu gadījumā

Abstract

Maģistra darba mērķis ir analizēt, vai un cik lielā apjomā ir nepieciešams nodrošināt valsts un pašvaldību iestāžu atbalsta pieejamību ģimenēm ar bērniem, kurās vecāki kara, militāra iebrukuma vai to draudu gadījumā būs iesaistīti valsts aizsardzības uzdevuma izpildē. Iepriekš Latvijā nav veikti šādi pētījumi. Šī pētījuma ietvarā tiek pētīts, vai un kādā veidā civilās aizsardzības sistēma, atbalstot valsts aizsardzības sistēmu, spēs realizēt to ģimeņu ar bērniem aizsardzību un sniegt tām atbalstu, kurās vecāki kara, militāra iebrukuma vai to draudu gadījumā tiks iesaistīti valsts aizsardzības uzdevuma izpildē. Tāpat, šī darba ietvarā autore pēta, kādi aspekti būtu jāparedz iepriekš, lai kara, militāra iebrukuma vai to draudu gadījumā nerastos situācija, ka ģimenes vērtību un bērnu tiesību aizstāvība kļūs apgrūtināta vai pat neiespējama, jo abi vienas ģimenes locekļi būs iesaistīti valsts aizsardzības uzdevuma izpildē. Maģistra darbs sastāv no teorētiskās un pētnieciskās daļas. Teorētiskajā daļā, balstoties uz zinātniskajiem avotiem tiek apskatīti bērnu tiesību uz ģimeni un vecāku klātbūtni tiesiskie aspekti, raksturota ģimenes un darba vides salāgošanas iespēja, ņemot vērā bērna labākās intereses ģimenēs, kurās vecāki ir iesaistīti valsts aizsardzības uzdevuma izpildē. No izanalizētajiem teorētiskiem skatījumiem darba pētnieciskajā daļā autore caur morāli ētisko prizmu, ievērojot bērnu vislabākās intereses pēta, kam jāuzņemas rūpes par bērniem ģimenēs, kurās vecāki pildīs valsts aizsardzības uzdevumu kara, militāra iebrukuma vai to draudu gadījumā, kādi ir iespējamie risinājumi bērnu tiesību aizsardzības jomā šajās ģimenēs, piedāvājot risinājumus, kā nodrošināt valsts un pašvaldību iestāžu atbalsta pieejamību šīm ģimenēm. Pētījumā ir izmantota jaukta tipa metodoloģija, pielietojot literatūras, pētījumu un judikatūras analīzi, kvalitatīvās (aptauja) un kvantitatīvās (daļēji strukturēta intervija, daļēji strukturēta biogrāfiska intervija) pētniecības metodes. Autore secina, ka maģistra darba mērķis ir sasniegts daļēji, jo karavīru bērnu aprūpes jautājums līdz šim Latvijā nav aktualizēts, tāpēc šobrīd nav nedz tiesiskā, nedz morālā ietvara šī jautājuma risinājumam. Autore uzskata, ka ir nepieciešams izveidot starpministriju darba grupu, lai aktualizētu ne tikai karavīru bet arī citos dienestos dienošo amatpersonu bērnu tiesību aizsardzību kara laikā.

The aim of the Master's thesis is to analyze whether and to what extent it is necessary to ensure the availability of support from state and local government institutions for families with children whose parents will be involved in the task of national defense in the event of war, military invasion or threat. No such studies have been conducted in Latvia before. This study examines whether and how the civil protection system, in support of the national defense system, will be able to protect and support families with children whose parents will be involved in the task of national defense in the event of war, military invasion or threat. Also, in the framework of this thesis, the author examines what aspects should be anticipated in order to prevent the defense of family values and children's rights from becoming difficult or even impossible in the event of war, military invasion or threat, because both members of the same family will be involved in national defense. The master's thesis consists of a theoretical and a research part. The theoretical part, based on scientific sources, examines the legal aspects of children's rights to family and parental presence and describes the possibility of reconciling family and work environment, taking into account the best interests of a child in families where parents are involved in national defense. From the analyzed theoretical views in the research part of the Thesis, the author, through the moral and ethical prism of children, examines who should take care of children in families where parents will be involved in the task of national defense in the event of war, military invasion or threat, and what are the possible solutions in the field of protection of children's rights in these families, offering solutions to ensure the availability of support from state and local government institutions for these families. The study uses a mixed type of methodology, applying the analysis of literature, research and case law, qualitative (survey), and quantitative (semi-structured interview, semi-structured biographical interview) research methods. The author concludes that the goal of the Master's thesis has been partially achieved, because the issue of childcare for soldiers has not been actualized in Latvia so far, therefore there is currently no legal or moral framework for resolving this issue. The author considers that it is necessary to establish an inter-ministerial working group to update the protection of the rights of children not only of soldiers but also of officials serving in other services during the war.
