Bērna kā cietušā nopratināšanas kriminālprocesā psiholoģiskie un organizatoriskie aspekti

Abstract

Maģistra darba tēma ir “Bērna kā cietušā nopratināšanas kriminālprocesā psiholoģiskie un organizatoriskie aspekti”. Tēmas aktualitāte un problēma saistīta ar to, ka Latvijā ik gadu no vardarbības un novārtā pamešanas cieš vairāk nekā divi tūkstoši bērnu. Procentuāli visvairāk noziedzīgo nodarījumu veikti pret dzimumneaizskaramību. Lai bērnam un viņa attīstībai radītu drošu un atbalstošu vidi, svarīga ir Latvijas bērnu tiesību aizsardzības sistēmas un tās efektivitātes stiprināšana. Viens no būtiskākajiem aspektiem noziedzīga nodarījuma atklāšanā ir bērna liecība. Veicot nopratināšanu ir svarīgi pēc iespējas mazāk emocionāli traumēt bērnu. Tomēr realitātē bērniem nereti nākas stāstīt par pieredzēto daudzas reizes – policistiem, mediķiem, psihologiem un sociālajiem darbiniekiem. Latvijas Republikas Satversmes 110. pants nosaka, ka valsts īpaši palīdz bērniem, kas cietuši no varmācības, valsts pienākums ir īpaši aizsargāt vardarbībā cietušā bērna tiesības. Norma tiek piemērota, bet tā nesasniedz likumdevēja iecerēto mērķi. Tādēļ darba mērķis bija izpētīt ar bērnu nopratināšanu saistīto tiesisko regulējumu un speciālistu publikācijas, identificēt tiesiska rakstura problēmas nepilngadīgo nopratināšanas organizācijā (procesā), piedāvāt risinājumus. Savukārt galvenais pētījuma jautājums bija: Kādas ir ar cietušo bērnu nopratināšanu saistītā tiesiskā regulējuma problēmas Latvijā, un kādi ir iespējamie risinājumi? Pētījumam tika izmantots starptautiskais tiesiskais regulējums, Latvijas tiesiskais regulējums, EST, ECT un LR Augstākās tiesas atziņas, kā arī dažādu autoru un ekspertu atziņas, un citi avoti.

The topic of the master's thesis is "Psychological and organizational aspects of questioning a child as a victim in criminal proceedings". The topicality and the problem of the topic is related to the fact that more than two thousand children in Latvia suffer from violence and neglect every year. The highest percentage of major crimes are committed against sexual integrity. In order to create a safe and supportive environment for the child and his or her development, strengthening the Latvian children's rights protection system and its efficiency is important. Essential aspect in detecting a crime is the child's testimony. It is important to cause as little emotional trauma to the child as possible during the interrogation. However, in reality, children often have to tell about their experiences many times - to police officers, doctors, psychologists and social workers. Section 110 of the Constitution of the Republic of Latvia states that the State shall, in particular, assist children who have suffered from violence with the duty of the State to protect the rights of the child victim of violence. The rule applies, but it does not achieve the aim pursued by the legislator. Therefore the aim of the work was to research legal solutions conected to the interrogation of children and related publications of specialists, to identify legal issues in the organization of interrogation of minors and propose solutions. The main research question was: What are the legal regulation problems related to the interrogation of child victims in Latvia, and what are the possible solutions? The international legal framework, the legal framework of Latvia, the findings of the CURIA, the ECHR and the Constitutional Court of the Republic of Latvia, as well as the findings of various authors and experts, and other sources were used for the research.
