Kriminālatbildība par viltus ziņu izplatīšanu internetā pandēmijas apstākļos

Abstract

Maģistra darba “Kriminālatbildība par viltus ziņu izplatīšanu internetā pandēmijas apstākļos” tēmas aktualitāte saistās ar tiesiska rakstura problēmām, kas radušās pēdējo divu gadu laikā, sakarā ar Covid-19 vīrusa izraisīto pandēmiju. Covid-19 pandēmija visā pasaulē, arī Latvijā izraisījusi ne vien veselības aprūpes pārslodzi un ekonomiskas problēmas, bet arī lielu sociālo spriedzi. Lai ierobežotu pandēmijas izplatību, tika noteikti dažādi ierobežojumi. Pandēmijas izraisītā spriedze un likumdevēja noteiktie ierobežojumi radīja augsni nepatiesas informācijas izplatībai. Īpaši aktuāli tas bija interneta vidē. Viltus ziņu ierobežošanai Tieslietu ministrija iesniedza Saeimā priekšlikumu Krimināllikuma grozījumiem, kas paredzētu kriminālatbildību par nepatiesu ziņu izplatīšanu. Par šo likumprojektu izvērsās diskusija gan juristu, gan politiķu vidē. Ņemot vērā šādu pretdarbību pandēmijas ierobežošanas centieniem, rodas jautājums, vai pašreizējais tiesiskais regulējums Krimināllikuma 231. pantā, kas paredz viltus ziņu izplatīšanu kvalificēt kā huligānismu, ir pieņemams tiesiskais risinājums. Pētījuma mērķis: izpētīt krimināltiesisko regulējumu, kas paredz atbildību par viltus ziņu izplatīšanu internetā pandēmijas apstākļos, un tā piemērošanas praksi, konstatēt iespējamus problēmjautājumus un piedāvāt tiem risinājumus. Pētījuma galvenie rezultāti liecina, ka pašreizējais tiesiskais regulējums Krimināllikuma 231. pantā, ko piemēro par nepatiesu ziņu izplatīšanu, praksē tiek veiksmīgi piemērots un jau veidojas tiesu prakse; tas ir ir samērīgs attiecībā pret noziedzīgā nodarījuma smagumu, un nav nepieciešama jauna norma Krimināllikumā, kurā būtu atsevišķi noteikta atbildība par viltus ziņu izplatīšanu internetā.

The topicality of the topic of the master's thesis "Criminal Liability for Dissemination of Fake News on the Internet in the Conditions of a Pandemic" is related to the legal problems that have arisen during the last two years due to the pandemic caused by the Covid-19 virus. The Covid-19 pandemic has caused not only overcrowding in health care and economic problems all over the world, including Latvia, but also great social tensions. Various restrictions were imposed to limit the spread of the pandemic. The tensions caused by the pandemic and the restrictions imposed by the legislature paved the way for the dissemination of false information. This was especially true in the Internet environment. In order to limit false information, the Ministry of Justice submitted to the Saeima a proposal for amendments to the Criminal Law, which would provide for criminal liability for the dissemination of false information. The bill was discussed by both lawyers and politicians. In the face of such a response to pandemic containment efforts, the question arises as to whether the current legal framework in Article 231 of the Criminal Code, which provides for the dissemination of false information to be classified as hooliganism, is an acceptable legal solution. Aim of the study: to study the criminal law framework for liability for the dissemination of false information on the Internet in the context of a pandemic and the practice of its application, to identify possible problems and offer solutions to them. The main results of the study show that the current legal framework in Article 231 of the Criminal Law, which applies to the dissemination of false information, is being successfully applied in practice and case law is already being developed. This is proportionate to the seriousness of the crime, and there is no need for a new provision in the Criminal Code that specifically sets out the responsibility for spreading false information on the Internet.
