Orgānu transplantācijas tiesiskais regulējums un tiesiskā regulējuma problēmas Latvijas Republikā

Abstract

Ņemot vērā to, ka cilvēka audu un orgānu transplantācija ir medicīnas joma, kura strauji attīstās un ļauj speciālistiem glābt dzīvību pacientiem pat ļoti sarežģītos gadījumos, tiesiskajam regulējumam orgānu transplantācijas jomā jābūt skaidram un saprotamam. Turklāt, tiesiskā regulējumā iekļautajām tiesību normām jāaizsargā gan dzīva, gan mirušā, gan potenciālā donora cilvēktiesības. Pastāv aktuālās problēmas, ka arī neskaidrības orgānu transplantācijas tiesiskajā regulējumā Latvijas Republikā, proti, jēdzienu “transplantācija” un “donors” definīciju nepilnības, sabiedrības zems informētības līmenis par Latvijas Republikā pastāvošu kārtību saistībā ar orgānu ziedošanu pēc nāves, informācijas, ko saņem potenciālais orgānu vai audu donors, trūkums u.c. Maģistra darba struktūru veido ievads, pamatdaļa, kas iedalīta nodaļās un apakšnodaļās un nobeigums. Ievads atklāj maģistra darba aktualitāti, pētāmās problēmas, pētījuma mērķi, pētījuma jautājumu un uzdevumus, kā arī pētījumā izmantotās zinātniskās un tiesību normu interpretācijas metodes. Pirmajā darba nodaļā autore pēta transplantācijas jēdziena un ar to saistīto jēdzienu definīcijas, ka arī noskaidro transplantācijas būtību caur transplantācijas vēsturisko attīstību. Otrajā darba nodaļā autore analizē starptautisko tiesisko regulējumu un pamatnostādnes orgānu transplantācijas jomā. Trešajā darba nodaļā autore pēta Latvijas Republikas orgānu transplantāciju reglamentējošus normatīvos aktus, ka arī noskaidro kā starptautiskie tiesību akti ietekmē nacionālo tiesisko regulējumu orgānu transplantācijas jomā. Maģistra darba nobeigumā, autore apkopo pētījuma gaitā gūtos secinājumus un piedāvā priekšlikumus tiesiskā regulējuma pilnveidošanai un problēmjautājumu risināšanai. Mērķis ir izpētīt orgānu transplantācijas tiesisko regulējumu Latvijā kopsakarā ar starptautisko tiesisko regulējumu orgānu transplantācijas jomā, konstatēt orgānu transplantācijas jomas tiesiskā regulējuma problēmas un sniegt priekšlikumus problēmjautājumu risināšanai. Maģistra darba apjoms ir 81 lappuse.

Considering the fact that transplantation of human tissues and organs is a rapidly evolving field of medicine that allows professionals to save lives, even in very difficult cases, the legal framework for organ transplantation must be clear and comprehensible, and the legal framework must protect rights of both living and dead human who is the potential donor. There are current problems, as well as uncertainties in the legal regulation of organ transplantation in the Republic of Latvia, namely shortcomings in the definitions of “transplantation” and “donor”, low level of public awareness of post – mortem organ donation, etc. The structure of the master's thesis consists of an introduction, the main part divided into chapters and subsections, and the conclusion. The introduction reveals the topicality of the master's thesis, the research problems, the aim of the research, the tasks and issues to be considered in the work, as well as the methods of interpretation of the research and legal norms used by the author during the development of the master's thesis. In the first chapter, the author studies the definitions of the concept of transplantation and related concepts, as well as the essence of transplantation through the historical development and ethical aspects of transplantation. In the second chapter of the study, the author analyzes the international legal framework and guidelines in the field of organ transplantation. In the third chapter, the author studies the normative acts regulating organ transplantation in the Republic of Latvia, and also finds out how international legal acts affect the national legal framework in the field of organ transplantation. At the end of the master's thesis, the author summarizes the conclusions obtained during the research and offers proposals for the improvement of the regulatory framework and problem solving. The aim of the master's thesis is to study the legal regulation of organ transplantation in the Republic of Latvia in connection with the international legal regulation in the field of organ transplantation, to identify legal issues in the field of organ transplantation and to provide proposals for solving problems. The volume of the master's thesis is 81 pages.
