Atjaunojošās justīcijas pieejas Latvijā: īstenošanas prakse un attīstības perspektīvas

Abstract

Darba tēma ir „Atjaunojošās justīcijas pieejas Latvijā: īstenošanas prakse un attīstības perspektīvas”. Darba mērķis ir analizēt atjaunojošās justīcijas teorētiskos un praktiskos aspektus, normatīvo regulējumu. Izpētīt atjaunojošās justīcijas pieeju, iespējas, procesus, to aktualitāti un problēmas, kā arī noskaidrot citu valstu, valsts iestāžu un nevalstisko organizāciju praksi šajā jautājumā. Darbā tiek izpētīta atjaunojošās justīcijas vēsturiskā attīstība Latvijas krimināltiesībās, analizēta atjaunojošās justīcijas terminoloģija; raksturoti atjaunojošās justīcijas mērķi un pamat-principi; raksturoti alternatīvie strīdu risināšanas veidi kā atjaunojošās justīcijas elementi; analizēta atjaunojošās justīcijas ietekme uz taisnīguma atjaunošanas procesu, salīdzināta atjaunojošā justīcija Eiropas Savienības dalībvalstīs, un konstatētas attīstības perspektīvas Latvijas Republikā. Balstoties uz literatūras analīzi, izdarīti secinājumi par atjaunojošās justīcijas attīstības perspektīvām, kā arī formulēti priekšlikumi atjaunojošās justīcijas pielietošanas tiesiskā regulējuma pilnveidošanai veidošanai Latvijā.

The aim of the work is to analyse the theoretical and practical aspects of restorative justice, the regulatory framework. Explore the RJ possibilities, methods, their relevance and problems, and clarify the practices of other countries, public authorities and public organisations on this issue. The work examines the historical development of restorative justice in Latvia's criminal law, analyses terminology of restorative justice; describe the objectives and basic principles of restorative justice; describe alternative ways of resolving disputes as elements of restorative justice; the effects of restorative justice on the process of restoring justice have been analysed, compared in the Member States of the European Union with the prospects for development in the Republic of Latvia. Based on a literature analysis, conclusions have been reached on the prospects for the development of restorative justice, as well as proposals for improving the legal framework for the application of restorative justice in Latvia.
