Abstract

Anotācija Maģistra darba temats “Provokācijas aizliegums speciālā izmeklēšanas eksperimenta veikšanā” autorprāt ir aktuāls, jo ir saskatāmas problēmas speciālā izmeklēšanas eksperimentā provokācijas nepieļaujamībai. Maģistra darba mērķis – izpētīt provokācijas aizliegumu speciālā izmeklēšanas eksperimentā tiesisko regulējumu, izteikt secinājumus un priekšlikumus tiesību normu un prakses pilnveidošanai. Izvēlētais darba izpētes objekts – speciālā izmeklēšanas eksperimenta rezultātā izveidojušās kriminālprocesuālās attiecības. Pētījuma priekšmets – speciālā izmeklēšanas eksperimenta tiesiskais regulējums. Izvirzītā mērķa sasniegšanai autors darbu iedala trīs nodaļās. Pirmajā nodaļā “Provokācijas būtība speciālā izmeklēšanas eksperimenta veikšanā” autors izzinās jēdziena “provokācija un kūdīšana” nozīmi, aplūkojot jēdzienu interpretāciju dažādos avotos un tiesu praksē, kā arī iepazīsies ar speciālā izmeklēšanas eksperimentā provokācijas nepieļaujamības spēkā esošo normatīvo regulējumu. Darba otrajā nodaļā “Izvērtējamie faktori provokācijas nekonstatēšanai speciālā izmeklēšanas eksperimentā” autors analizēs provokācijas nepieļaušana veicot speciālo izmeklēšanas eksperimentu. Darba trešajā nodaļā “Procesuālo kļūdu ietekme uz speciālā izmeklēšanas eksperimenta rezultātu izmantošanu pierādīšanā” autors analizēs kādas kļūdas tiek pieļautas veicot speciālo izmeklēšanas eksperimentu un sniegs šo problēmu risinājumu. Maģistra darba izstrādes gaitā izmantoti normatīvie akti, juridiskā literatūra, tiesu prakses materiāli. Darbā izmantotas tādas pētījumu metodes kā vēsturiskā pētniecības metode, salīdzināmā tiesību metode, analītiskā pētniecības metode, deskriptīvā (aprakstošā) metode un loģiski konstruktīvā pētniecības metode. ANNOTATION Master's Thesis Topic “Prohibition of Provocation in a Special Investigation Experiment” in the author's opinion, it is topical, because there are visible problems in a special investigative experiment for the inadmissibility of provocation. The aim of the master's thesis is to study the legal regulation of the prohibition of provocation in a special investigative experiment, to express conclusions and proposals for the improvement of legal norms and practice. The chosen object of research is the criminal procedural relations established as a result of a special investigative experiment. The research subject - legal regulation of a special investigation experiment. To achieve the set goal, the author divides the work into three chapters. In the first chapter “The essence of provocation in the performance of a special investigative experiment” the author will learn the meaning of the term “provocation and incitement”, looking at the interpretation of concepts in different sources and case law, as well as will get acquainted with the valid regulatory framework of inadmissibility of provocation in a special investigation experiment. In the second chapter “Factors to be evaluated for non-detection of provocation in a special investigation experiment”, the author will analyze the prevention of provocation by performing a special investigation experiment. In the third chapter “The influence of procedural errors on the use of the results of a special investigative experiment in proof” the author will analyze what mistakes are made during a special investigative experiment and will provide a solution to these problems. While developing master’s thesis author used n normative acts, legal literature, case law materials. The research methods are used in the work are historical research method, comparable method of law, analytical research method, descriptive method and logically constructive research method. Thesis consists of: 87 pages, used 97 sources of used literature and information.
