Tiesību uz vārda brīvību un tiesību uz privātumu un Eiropas Savienības personas datu aizsardzību konkurences problēmas

Abstract

Maģistra darbā „Tiesību uz vārda brīvību un tiesību uz Eiropas Savienības personas datu aizsardzību konkurences problēmas” ir pētīti vārda brīvības un privātuma, īpaši personas datu aizsardzības, tiesību normu kolīzijas jautājumi. Personas datu aizsardzībai Eiropas Savienībā un Latvijā tiek pievērsta liela nozīme kopš Vispārējās datu aizsardzības regulas stāšanās spēkā 2018.gada 25.maijā. Personas datu aizsardzība ietilpst privātuma tiesību tvērumā. Kopš ES līmenī pausts uzsvars uz personas datu aizsardzības nodrošināšanu, cilvēka pamattiesību uz vārda brīvību un privātuma tiesību konkurence ir kļuvusi vēl aktuālāka. Praksē nav iespējams vienlaicīgi apmierināt šādu pretēju tiesību prasījumus, un tas dažādās situācijās prasa atrast interešu līdzsvaru. Maģistra darba mērķis ir izpētīt tiesību uz vārda brīvību un tiesību uz privātumu un ES personas datu aizsardzību konkurences problemātiku un identificēt priekšlikumus tiesiskā regulējuma pilnveidošanai. Maģistra darbā, balstoties uz tiesisko regulējumu, tiesu praksi un dzīves novērojumiem, noskaidroti problēmjautājumi, kas izriet no pretējo cilvēka pamattiesību konkurences un formulēti priekšlikumi tiesiskā regulējuma pilnveidošanai. Maģistra darbu veido ievads, trīs nodaļas, kas sadalītas apakšnodaļās, un nobeigums ar secinājumiem un priekšlikumiem, literatūras un darbā lietoto avotu saraksts un pielikumi. Maģistra darba kopējais apjoms ir 90 lapas.

The conflict issues of rights to freedom of expression and rights to privacy, especially personal data protection, are examined in the master's thesis “Competition Problems of the Right to Freedom of Expression and the Right to EU Personal Data Protection”. The protection of personal data has been of great importance in the European Union and Latvia since the General Data Protection Regulation entered into force on 25 May 2018. The protection of personal data falls within the scope of the right to privacy. The competition between the fundamental human right to freedom of expression and the right to privacy has become even more important since the protection of personal data is emphasized at EU level. In practice, it is not possible to satisfy claims of such opposite rights at the same time and this requires finding a balance of interests in different situations. The objective of the master's thesis is to study the competition issues of the right to freedom of expression and the right to privacy and the EU personal data protection and to identify proposals for the improvement of the legal framework. Based on the legal framework, court practice and observations of life, problems arising from the competition of the opposite fundamental human rights are clarified and proposals for the improvement of the legal framework are formulated in the master's thesis. The master's thesis consists of an introduction, three chapters divided into subsections, and a closure with conclusions and proposals, a list of literature and sources used in the work, and appendices. The total volume of the master thesis is 90 pages.
