Fizisko personu nekustamo īpašumu atsavināšanas tiesiskais regulējums un prakses problēmas

Abstract

Anotācija Maģistra darba tēma: „Fizisko personu nekustamo īpašumu atsavināšanas tiesiskais regulējums un prakses problēmas” ir aktuāla visām fiziskām personām, kuras pārdeva vai plāno pārdot savu nekustamo īpašumu, jo Latvijas Republikā pastāvošais tiesiskais regulējums ir nepilnīgs un praksē tiek konstatētas vairākas problēmas. Nekustamo īpašumu pārdevēji mēdz izvairīties no tiesiskajā regulējumā paredzētajiem pienākumiem: piedāvāt izmantot pirmpirkuma tiesības tiesīgajām personām, veikt pirkuma cenas samaksu tikai ar pārskaitījumu, nomaksāt kapitāla pieauguma nodokli, nostiprināt savas īpašumtiesības zemesgrāmatā u.c., tādā veidā apdraudot savas, tiesīgo personu, kā arī valsts un pašvaldību tiesības un intereses. Maģistra darba mērķis: konstatēt fizisko personu nekustamo īpašumu pārdošanas tiesiskā regulējuma nepilnības un prakses problēmas, kā arī izstrādāt priekšlikumus skaidram, precīzam un efektīvam fizisko personu nekustamo īpašumu pārdošanas procesam, kurš atbilst Latvijas Republikas normatīvo aktu prasībām. Darba autore secina, ka: 1) ne vienmēr tiek ievērotas trešo personu tiesības; 2) kapitāla pieauguma nodokļa tiesiskajā regulējumā pastāv vairākas neskaidrības un nepilnības; 3) zemesgrāmatu ieraksti ne vienmēr atbilst faktiskajai situācijai; 4) darījuma puses mēdz pārkāpt normatīvo aktu prasības u.c. Maģistra darbs sastāv no ievada, divām nodaļām, anotācijas latviešu un angļu valodā, nobeiguma, kurš ietver secinājumus un priekšlikumus, ir uzrakstīts uz 83 lapām un ietver 5 pielikumus. Darba izstrādei izmantoti 129 literatūras un informācijas avoti.

Annotation The topic of the Master’s thesis: „Legal Regulation of Alienation of Real Estate of Individuals and Practice Problems” is important for all natural persons who have sold or are planning to sell their real estate, because the legal regulation existing in the Republic of Latvia is incomplete and practice shows several problems. Real estates sellers tend to evade the obligations provided for in the legal regulations: to offer the persons entitled to use their pre-emption rights, to make the payment of the purchase price as a bank transfer only, to pay capital gains tax, to register their property right in the land registry, etc., thus jeopardising their own rights and interests as well as those of entitled persons, the state and municipalities. The research aim is to find deficiencies and practice problems in the legal regulation of the sale of real estate by natural persons and design recommendations for a clear, specific, and efficient real estate sales process by natural persons, which corresponds to the requirements of the laws and regulations of the Republic of Latvia. The author of the paper concludes that: 1) third party rights are not always observed; 2) the legal regulation for capital gains tax contains several ambiguities and deficiencies; 3) land registry records do not always correspond to the real situation; 4) transaction parties tend to breach the requirements of the laws and regulations, etc. The Master’s thesis consists of an introduction, two chapters, an abstract in Latvian and English, and a final conclusion, which includes research conclusions and recommendations. The thesis contains 83 pages and 5 appendices. 129 literature and information sources have been used to write the paper.
