Cilvēktiesību aspekti mikroshēmu implantēšanā cilvēkiem

Abstract

Maģistra darbs “Cilvēktiesību aspekti mikroshēmu implantēšanā cilvēkiem” ir zinātnisks pētījums, kurā sistēmiski analizēti ar cilvēktiesībām saistīti jautājumi, kas izriet no valsts un privātpersonu, kā arī fizisku un juridisku personu tiesiskajām attiecībām cilvēku mikročipēšanas jomā nemedicīniskos nolūkos. Maģistra darbā tiek pētīts mikroshēmu implantēšanas cilvēkiem jēdziens un būtība, cilvēktiesību tiesiskā regulējuma un cilvēku mikročipēšanas mijiedarbība ar tiesībām uz privāto dzīvi, tiesībām uz personas datu aizsardzību, tiesībām uz darbu un tiesībām uz veselību, kā arī tiek analizēta Amerikas Savienoto Valstu (ASV) pieredze mikroshēmu implantēšanas cilvēkiem jomā un tiek pamatota mikročipēšanas tiesiskā regulējuma nepieciešamība un īstenošanas iespējamība nacionālajā tiesību sistēmā. Valsts un privātpersonu, kā arī fizisku un juridisku personu tiesiskās attiecības cilvēku mikročipēšanas jomā līdz šim Latvijā nav pētītas un tiešā veidā netiek regulētas ne starptautiskajos, ne nacionālajos tiesību aktos, neskatoties uz to, ka vismaz 20 dažādās pasaules valstīs kopumā jau vairāk nekā 50 000 cilvēku sev zem ādas ir implantējuši radiofrekvenču identifikācijas (RFID) mikroshēmas. Maģistra darba mērķis ir izstrādāt zinātnisku pētījumu un, analizējot cilvēktiesību aspektus mikroshēmu implantēšanas cilvēkiem jomā, sniegt priekšlikumus nacionālā tiesiskā regulējuma izstrādei cilvēku mikročipēšanas jomas aizsardzības un konkretizācijas nolūkos. Maģistra darbs sastāv no ievada, 4 nodaļām, nobeiguma un izmantotās literatūras avotu saraksta kopā uz 103 lapām.

This master thesis “Human Rights Aspects in Microchip Implantation for Humans” is a scientific study with a systemic analysis of human rights related questions arising from the legal relationship between the state and individuals, as well as individuals and legal entities in the field of human microchipping for non-medical purposes. The thesis deals with the concept and essence of human implantation of microchips, the interaction of human rights law and human microchipping with the rights to privacy, rights to protection of personal data, working rights, the rights to health, and analyses the experience of the United States in the field of human implantation, as well as discusses the necessity and feasibility of the legal regulation of microchipping in the national legal system. The legal relations between the state and private persons, as well as natural and legal persons in the field of human microchipping up to now have not been studied in Latvia and are not directly regulated by any international or national legislation, despite the fact that more than 50 000 people in at least 20 different countries have already implanted radio frequency identification (RFID) chips under the skin. The goal of this master thesis is to develop a scientific study and, with the help of an analysis of human rights aspects in the field of human implantation of microchips, to present proposals for developing a national legal framework for the protection and specification of the field of human microchipping. The thesis consists of an introduction, four chapters, conclusion and the listing of sources, altogether on 103 pages.
