Pašvaldības pedagoģiski medicīniskā komisija kā iekļaujošās izglītības sastāvdaļa, tās kompetence: pienākumi, tiesības un atbildība

Abstract

Lai īstenotu savas pamattiesības uz izglītību, Latvijā ik gadu vidēji 7000 bērniem uz pedagoģiski medicīniskās komisijas atzinuma pamata ir nodrošināma izglītība speciālās jeb iekļaujošās izglītības programmu ietvaros. Viens no iekļaujošās izglītības pamatelementiem ir diskriminācijas aizliegums. Liela loma speciālās izglītības iespēju nodrošināšanai bērniem, ievērojot bērna labāko interešu principa nodrošināšanu un darbojoties tikai un vienīgi saskaņā ar spēkā esošajiem normatīvajiem aktiem, ir pašvaldībām. Autore praksē ir saskārusies ar pastāvošajām problēmām normatīvo aktu piemērošanā un interpretēšanā attiecībā uz PPMK darbību Aizputes novadā, kad tiek būtiski ierobežotas bērna ar speciālajām vajadzībām tiesības uz izglītību un netiek pildītas likumā noteiktās tiesību normas par speciālās izglītības nodrošināšanu. Pētījuma mērķis ir, analizējot PPMK darbību reglamentējošos normatīvos aktus saistībā ar bērnu tiesību ievērošanu, identificēt problēmas un sniegt priekšlikumus tiesiskā regulējuma un to ieviešanas uzlabojumiem Aizputes novadā. Pētījuma gaitā autore izpētījusi tiesisko regulējumu bērna tiesībām uz izglītību, apskatījusi iekļaujošās izglītības tiesisko ietvaru Latvijā, izpētījusi pašvaldību lomu iekļaujošās izglītības nodrošināšanā gan Latvijā, gan ārvalstīs, kā arī analizējusi PPMK darbību Latvijā un tieši Aizputes novadā. Pētījuma rezultātā ir konstatētas nepilnības Aizputes novada PPMK normatīvajā regulējumā, proti, interešu konflikta pastāvēšana, pašvaldības prettiesiska rīcība atsakoties nodrošināt speciālās izglītības programmu, labas pārvaldības principa neievērošana. Vienlaicīgi autore ir izstrādājusi priekšlikumus nelabvēlīgu apstākļu novēršanai bērna pamattiesību realizācijas nodrošināšanai. Darbs sastāv no 93 lapām, izmantoto avotu un literatūras saraksta, kā arī 8 pielikumiem.

In order to implement their fundamental right to education, an average of 7000 children in Latvia each year are provided with education in the framework of special or inclusive education programmes on the basis of the opinion of the Pedagogical Medical Commission. One of the key elements of inclusive education is the prohibition of discrimination. Municipalities play an important role in providing special education opportunities for children, respecting the principle of the best interests of the child and acting solely in accordance with the laws and regulations in force. In practice, the author has encountered existing problems in the application and interpretation of the laws and regulations regarding the operation of PPMK in Aizpute municipality, where the right to education of the child with special needs is significantly restricted and the legal provisions on the provision of special education are not fulfilled. The aim of the study is to analyse the regulatory enactments governing the functioning of the PPMK in relation to respect for children's rights, to identify problems and to make proposals for improvements in implementation of the legal framework in Aizpute municipilaty. In the course of the study, the author has studied the legal framework for the child's right to education, looked at the legal framework for inclusive education in Latvia, studied the role of municipalities in providing inclusive education both in Latvia and abroad, as well as analysed the activities of PPMK in Latvia and directly in Aizpute municipality. The study has revealed shortcomings in the regulatory framework of the PPMK of Aizpute municipality, i.e. the existence of a conflict of interest, the unlawful conduct of the municipality by refusing to ensure a special education programme, failure to comply with the principle of good governance. At the same time, the author has made proposals to prevent disadvantages in ensuring the exercise of the fundamental rights of the child.
