Elektroniskās informācijas sistēmās esošo personas datu apstrādes tiesiskie aspekti tiesībaizsargājošās institūcijās

Abstract

Maģistra darbs ir autores pētījums par elektroniskās informācijas sistēmās esošo personas apstrādes tiesiskie aspektiem tiesībaizsardzības institūcijās . Pētījuma robežas – elektronisko sakaru komersantu rīcībā esošo komunikācijas datu nodošanas Valsts policijai tiesiskie aspekti. Tēmas aktualitāte ir saistīta ar šo datu iegūšanas nozīmīgumu bezvēsts pazudušo personu meklēšanā, Covid-19 inficēto personu un to kontaktpersonu atrašanās vietas noskaidrošanu, kā arī noziedzīgu nodarījumu izmeklēšanā. Šo datu izsniegšana ir saistīta ar personas tiesībām uz privātās dzīves neaizskaramību ierobežošanu. Šī darba juridiskā problēma ir saistīta ar tiesiskā regulējuma nevienlīdzīgiem kritērijiem cilvēka pamattiesību ierobežošanas aspektā. Maģistra darba mērķis ir izpētīt elektroniskās informācijas sistēmā esošo personas datu apstrādes tiesiskos aspektus Valsts policijā, norādīt uz šīs jomas tiesiskām problēmas un ieteikt to risinājumus. Darba ietvaros tiks noskaidrotas tiesībaizsardzības institūcijām izvirzītās prasības komunikācijas datu iegūšanā, lai nepieļautu nepamatotu iejaukšanās personas dzīvē. Darbs sastāv no 89 lappusēm.

The master's thesis is the author's research on the legal aspects of personal data processing in electronic information systems in law enforcement institutions. Boundaries of the research - legal aspects of transferring communication data at the disposal of electronic communications merchants to the State Police. The topicality of the topic is related to the importance of obtaining this data in the search for missing persons, the location of Covid-19 infected persons and their contact persons, as well as in the investigation of criminal offenses. The release of this data is linked to the restriction of a person's right to privacy. The legal problem of this work is related to the unequal criteria of the legal regulation in the aspect of restriction of fundamental human rights. The aim of the master's thesis is to study the legal aspects of personal data processing in the electronic information system in the State Police, to point out the legal problems in this field and to suggest their solutions. Within the framework of the work, the requirements set for law enforcement institutions in obtaining communication data will be clarified in order to prevent unreasonable interference in a person's life. The work consist of 89 pages.
