Valsts aizsargājamo dabas vides objektu apdraudējumi: raksturojums un novēršanas problēmas

Abstract

Maģistra darba tēma “Valsts aizsargājamo dabas vides objektu apdraudējumi: raksturojums un novēršanas problēmas,” ir īpaši aktuāla sakarā ar dabas vides objektu apdraudējumu pieaugumu. Dabas vides aizsardzībai nepieciešama pastiprināta tiesiskā aizsardzība. Dabas vides aizsardzības tiesības 21.gadsimtā mūsdienu pasaulē un arī Latvijā ir īpaši svarīga joma, kas palīdz juridiski saglābāt un aizsargāt cilvēces un valstu būtiskākās vērtības- dabiskos dzīves apstākļus un dabas vides objektus. Darba mērķis: analizējot valsts aizsargājamo dabas vides apdraudējumu novēršanas tiesisko regulējumu tiesiskās attiecības, identificēt problemas un izstrādāt priekšlikumus to novēršanai. Pētījuma objekts: tiesiskās attiecības saistībā ar valsts aizsargājamo dabas vides objektiem. Pētījuma priekšmets: valsts aizsargājamo dabas vides objektu apdraudējumu novēršanas tiesiskais regulējums. Noteiktā mērķa sasniegšanai ir izvirzīti uzdevumi: 1. Izpētīt valsts aizsargājamo dabas vides objektu jēdzienu, tā vēsturisko attīstību. 2. Izpētīt valsts aizsargājamo dabas vides objektu apdraudējumu raksturojumu. 3. Analizēt valsts aizsargājamo dabas vides objektu tiesisko regulējumu, identificēt apdraudējumu novēršanas problēmas tiesiskajā regulējumā un izstrādāt priekšlikumus tiesiskā regulējuma pilnveidošanai. Darbā izmantotas tiesību normu interpretācijas metodes: gramatiskā (fililoģiskā), vēsturiskā, sistēmiskā, aprakstošā, analitiskā, salīdzinošā, teoloģiskā (jēgas un mērķa) metodes. Darba saturs izklāstīts trijās daļās ar nodaļām un apakšnodaļām. Darba pirmās daļas ietvaros tika analizēti: Dabas vides objektu aizsardzību no apdraudējumiem teorētiskie un praktiskie aspekti; Darba otrās daļas ietvaros tika analizēts: Pētījuma priekšmeta juridiskais aspekts; Darba trešās daļas ietvaros tika analizēti: Valsts aizsargājamo dabas vides objektu apdraudējumu novēršanas problēmas un to risinājumi. Nobeigumā: Secinājumi un izstrādātie priekšlikumi tiesiskā regulējuma pilnveidošanai.

The theme of the thesis is Review of prevention of the threats to State Protected Natural environmental objects and the problems occurring. The enhanced legal frameworks are required to achieve better results in the protection of the environment around us. Environmental law is very topical and especially important area in the modern World of 21st century and particular in Latvia, which legally helps to preserve and protect the most important values of humanity and countries - natural inhabitant and natural environmental objects. The aim of the thesis is to analyse the legal relations of the regulations to prevent hazards to the state protected natural environment and identify problems and find proposals to sort those issues. The research objective is to look on the legal relationship of the environmental law, further looking into legal regulations of the threat prevention to state protected natural environment objects. In order to achieve the set goal, several tasks have been set: 1. To study the concept of state protected natural environment objects and how it developed with time. 2. To research the threats to state protected natural environment objects. 3. To analyse the legal regulation of the state protected natural environment objects, to identify the problems of threat prevention in the legal regulation and to develop proposals for the further regulation improvement. Research methods used in the work: grammatical (philological), historical, systemic, descriptive, analytical, comparative, theleological (meaning and purpose) methods. The thesis consists of three main chapters each of them having subsections. Theoretical and practical aspects of protection of natural environment objects from occurring threats were analysed in the first part. Second part gives overlook to legal aspect of the research subject. Problems of prevention of the threats to state protected natural environment objects and their solutions – were analysed in the third part of the work. Conclusion gives overlook into developed proposals for the improvement of the existing legal framework.
