Mantas īpašās konfiskācijas tiesiskais regulējums un problemātika

Abstract

Maģistra darba temats ir “Mantas īpašās konfiskācijas tiesiskais regulējums un problemātika.” Temats ir nozīmīgs, jo, lai gan pēc būtības šaurs, iekļauj sevī daudzus materiāltiesiskus un procesuāltiesiskus aspektus, kas Latvijas tiesību zinātnē nav līdz galam izpētīti. Maģistra darbā tiks noskaidrots, vai apstiprinās hipotēze: Konfiscējot mantu saskaņā ar Krimināllikuma VIII2 nodaļu “Mantas īpašā konfiskācija”, kriminālprocesuālais regulējums nav pietiekams, lai ātri un efektīvi atrisinātu mantiskos jautājumus kriminālprocesā. Izstrādājot maģistra darbu, autors apskatīs dažādu tiesību zinātņu ekspertu atziņas, analizēs normatīvo aktu grozījumus, kā arī darba izstrādes gaitā autors pētīs Latvijas Republikas Satversmi, Krimināllikumu, Kriminālprocesa likumu un citus normatīvos aktus. Darba izstrādes gaitā autors analizēs tiesu praksi saistībā ar mantas īpašo konfiskāciju. Maģistra darbs sastāv no ievada, trim nodaļām ar apakšnodaļām un nobeiguma. Maģistra darba pirmajā nodaļā darba autors atspoguļos mantas īpašās konfiskācijas institūta raksturojumu, kas sevī iekļauj arī divu pastāvošo modeļu: non – conviction based (bez notiesājoša sprieduma) un conviction based (ar notiesājoša sprieduma) aprakstu, kā arī mantas konfiskācijas vēsturisko attīstību Latvijas teritorijā. Maģistra darba otrajā nodaļā tiks analizēti mantas īpašās konfiskācijas veidi un procesuālā problemātika. Darba trešajā nodaļā autors sniegs ieskatu citu valstu normatīvajā regulējumā saistībā ar mantas konfiskāciju. Darbā tiks apkopoti secinājumi un izvirzīti priekšlikumi normatīvo aktu pilnveidošanai. Maģistra darba apjoms – 77lpp.

Scope of this master's thesis is “Regulatory framework and application problems of Special Confiscation of Property”. This subject is relevant, although it is narrow, because it encompasses many aspects of material and procedural law, which are not extensively studied in Latvian law. Main hypothesis that author will clarify or confirm in this master's thesis is whether legal framework of confiscating the property using section VIII2 ” Special Confiscation of Property” of Criminal law is or is not sufficient in order to quickly and effectively resolve property issues in criminal proceedings. In development of this master’s thesis the author will look at the conclusions of various law experts, analyze amendments to regulatory enactments and will study the regulation of the Constitution of the Republic of Latvia, Criminal Law, Criminal Procedure Law and other regulatory enactments. During the study author will also analyze case-law of Special Confiscation of Property. Master's thesis consists of an introduction, three chapters with subdivisions and a conclusion. In the first section of the Master's thesis, the author will reflect the characteristics of the institute of Special Confiscation of the Property, which also includes a description of two existing models: non – conviction based and conviction based confiscation of property, as well as the historic development of seizure of property in the territory of Latvia. The second section of the master's thesis the author will analyze the types of Special Confiscation of the Property and the problems encountered in aplication of procedural law. In the third section of master's thesis the author will give an insight into the legal framework of other countries relating the seizure of property. At the end of this master's thesis the author will summarize conclusions and put forward proposals to improve existing legal framework. Master's thesis consists of 77 pages.
