Valsts starptautiski tiessikā atbildība par bērnu izmantošanu karavīru statusā

Abstract

Maģistra darbā „Valsts starptautiski tiesiskā atbildība par bērnu izmantošanu karavīru statusā” izpētīta tāda globāla problēma kā bērnu tiesību sistemātiska pārkāpšana, izmantojot viņus bruņotās grupās kā karavīrus. Pētījuma mērķis ir izpētīt starptautiski tiesisko regulējumu, kas piemērojams šajā jomā, konstatēt starptautisko standartu nepilnības, kā arī valsts starptautiski tiesisko atbildību. Īpaša uzmanība ir pievērsta bērnu tiesību reglamentējošajiem normatīvajiem aktiem, tostarp starptautiskajām humanitārajām tiesībām ciktāl tās attiecināmas uz bērnu-karavīru jautājumu. Pētījuma rezultātā izdarīti vairāki secinājumi, kas saistīti ar esošo starptautisko tiesību standartu „robiem”, to ierobežoto attiecināmību uz šo jomu, kā arī reālas un efektīvas rīcības trūkumu un tās uzlabošanas nepieciešamību. Tika izstrādāti arī daži priekšlikumi attiecībā uz vēlamajiem grozījumiem starptautiskajos tiesību standartos, lai, ja ne pavisam izskaustu, tad vismaz mazinātu bērnu tiesību pārkāpumus šīs globālās problēmas ietvaros. Darba apjoms ir 74 lapas.

This Master thesis „State Responsibility for Child Soldiers under International Law” studies the global problem of regular child rights breaches using them as soldiers in the armed groups. The goal of this research is to study the international legislation that applies to this field, find gaps in the international standards as well as the states international legal liability. Special attention has been paid to the instruments that govern child rights including international humanitarian law as far as it is related to the child-soldiers issue. As a result of this research several conclusions have been made in relation to the “gaps” of the existing international legal standards, the limited scope of the application of international legal standards to the child-soldiers issue and the lack of real and effective action to redress and improve the situation. Several proposals have been developed concerning the preferable amendments in the international legal standards in order to reduce the breaches of the child rights in the framework of this global problem. The work consists of 74 pages.
