Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma un proliferācijas finansēšanas novēršanas tiesiskā regulējuma piemērošanas problēmas nefinanšu sektorā

Abstract

Maģistra darbs “Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma un proliferācijas finansēšanas tiesiskā regulējuma piemērošanas problēmas nefinanšu sektorā” ir pētījums, kura mērķis ir identificēt tiesiskā regulējuma piemērošanas problēmas attiecībā uz noteiktu nefinanšu sektora dalībnieku, kuri pakļauti augstam NILL riskam, iekšējās kontroles sistēmas aspektiem. Pētījuma ietvaros secināts, ka atsevišķi regulējuma aspekti attiecībā uz darījumiem ar politiski nozīmīgām personām un uz ziņošanas pienākumu par aizdomīgiem darījumiem vērtējami kā neatbilstoši samērīguma principam. Pētījuma ietvaros izstrādāti priekšlikumi tiesiskā regulējuma grozījumiem. Pētījums izstrādāts trīs darba nodaļās, kopā uz 91 lappuses.

The master thesis “Problems in Application of Ant-money Laundering and Terrorism and Proliferation Financing Legal Regulations in Non-Financial Sector” is a research that aims to identify problems with application of the legal regulations in respect to specific aspects of the internal control system of certain members of the non-financial sector, who are exposed to high money-laundering risk. Within the framework of the research it has been concluded that certain aspects of the legal regulation on conducting business with politically exposed persons and on submitting reports on suspicious transactions can be considered as incompatible with the principle of proportionality. The research concludes with proposal for improving the existing legal regulations. The research has been developed in three chapter, all together on 91 pages.
