Adopcijas tiesiskais regulējums un problemātika Latvijas Republikā

Abstract

Maģistra darba tēma ir “Adopcijas tiesiskais regulējums un problemātika Latvijas Republikā”. Kļūstot aktuālākiem tādiem adopciju veicinošajiem faktoriem kā vēlāka stāšanās laulībā un bērnu plānošana, pieaugošais neauglības gadījumu un šķirto laulību skaits, kā arī dažādu ģimenes modeļu pieņemšana sabiedrībā, aizvien vairāk diskusijas raisa dažādi ar adopciju saistītie aspekti, piemēram, vai ar adopciju tiek nodrošināta bērna vislabāko interešu ievērošana. Pētnieciskā darba mērķis ir, izzinot adopcijas jēdzienu, izpētot nacionālo un starptautisko normatīvo regulējumu, raksturot problēmsituācijas, lai piedāvātu iespējamos tiesiskos risinājumus un sniegtu priekšlikumus tiesiskā regulējuma pilnveidošanai. Pētījuma rezultātā tiek secināts, ka, neraugoties uz plašo un daudzveidīgo regulējumu adopcijas jomā, tajā joprojām saskatāmi trūkumi un riski, kuru novēršanai nepieciešama aktīva valsts līdzdalība, gan turpinot normatīvā regulējuma attīstību, gan arī veicinot bērnu tiesību un vislabāko interešu aizsardzību praksē. The theme of the Master’s thesis is “Legal regulation of adoption and its problems in Republic of Latvia”. As factors such as later marriage and child planning, the growing number of infertility and divorces, and the acceptance of different family models in society become more relevant, various aspects of adoption are increasingly debated, including whether adoption in in the best interests of the child. The aim of the thesis is to investigate the concept of adoption and to research national and international regulation and to describe problem situations in order to offer possible legal solutions and improvement of the legal framework. The result of this thesis concludes that despite the extensive and diverse regulation in the field of adoption, it still shows risks, the elimination of which requires the active participation of the state, both in the further development of the regulatory framework and in promoting the protection of children's rights and best interests in practice.
