Izteiksmes brīvības robežas sociālajos tīklos: tiesiskās regulējuma perspektīvas

Abstract

Darba temats ir “Izteiksmes brīvības robežas sociālajos tīklos. Tiesiskā regulējuma perspektīvas”. Temata aktualitāte ir pamatota ar sociālo tīklu pieaugošo ietekmi uz izteiksmes brīvības īstenošanu. Darbā autors izpētīja citu valstu jaunāko tiesisko regulējumu izteiksmes brīvības ierobežošanā sociālajos tīklos, kā arī analizēja aktuālāko reģionālo un nacionālo tiesu praksi. Darba mērķis ir noskaidrot izteiksmes brīvības ierobežošanas mehānismus sociālajos tīklos un to atbilstību starptautiskajiem tiesību standartiem. Darbs parāda ka aktuālie izteiksmes brīvības ierobežojumi sociālajos tīklos mēdz neatbilst starptautisko tiesību standartiem, atsevišķu valstu sociālo tīklu tiesiskais regulējums veido “labvēlīgu klimatu” cenzūrai, kā arī kopumā sociālo tīklu tiesiskais regulējums ir jauna parādība. Darbs sastāv no 123 lapaspuses.

The topic of this work is “Frontiers of freedom of expression on social networks. Legislative outlooks”. The focus of the topic is based on the increasing impact of social networks on the exercise of freedom of expression. In the work, the author have studied latest legal frameworks of other countries for limiting freedom of expression on social networks, as well analyzed the most current regional and national case-law. The aim of the work is to identify the mechanisms for limiting freedom of expression on social networks and their compliance with international law standards. This work shows that the current restrictions on freedom of expression on social networks tend to be inconsistent with the standards of international law, the legal framework of individual national social networks constitutes a “favourable climate” for censorship and, overall, the legal framework for social networks is a new phenomenon. Work consists of 123 pages.
