Preventīvo pasākumu īstenošana ceļu satiksmes jomā, tiesiskie aspekti un problemātika.

Abstract

Maģistra darba tēma ir "Preventīvo pasākumu īstenošana ceļu satiksmes jomā, tiesiskie aspekti un problemātika". Darba temats uzskatāms par aktuālu, jo personai pārkāpjot ceļu satiksmes noteikumus un izraisot ceļu satiksmes negadījumu, kuros ik gadu mirst liels personu skaits, tiek ietekmētas ar Latvijas Republikas Satversmi aizsargātas personas tiesības uz dzīvību un veselību. Maģistra darba mērķis ir izanalizēt preventīvo pasākumu ceļu satiksmes drošības jomā tiesisko regulējumu, tā problēmas un sniegt problēmu risinājumus. Darba autore, veicot pētījumu konstatēja, ka ceļu satiksmes drošības preventīvo pasākumu tiesiskajā regulējuma pastāv problēmas, kuras saistītas ar: 1) Valsts policiju darbinieku trūkumu un Pašvaldības policijas ierobežotajām funkcijām ceļu satiksmes jomā, kas kavē ceļu satiksmes noteikumu pārkāpēju operatīvu konstatēšanu un to saukšanu pie normatīvajos aktos paredzētās administratīvās vai kriminālas atbildības, 2) piemērojamo administratīvo sodu izvēles iespēju ierobežošanu, kas samazina iespējas izvēlēties pēc iespējas efektīvāku administratīvo sodu, kas atturētu ceļu satiksmes likumpārkāpējus veikt atkārtotus likumpārkāpumus ceļu satiksmes jomā. Lai risinātu konstatētas problēmas, autore piedāvā veikt grozījumus šādos ar ceļu satiksmes prevenciju saistītajos normatīvo aktos - Administratīvās atbildības likumā, Ceļu satiksmes likumā un Ministru kabineta 27.11.2018. noteikumos Nr. 719. „Kārtība, kādā nosaka alkohola koncentrāciju asinīs un izelpotajā gaisā un konstatē narkotisko vai citu apreibinošo vielu ietekmi”.

The topic of the master's thesis is "Implementation of preventive measures in the field of road traffic, legal aspects and problems". The theme of the master’s paper is considered topical, because when a person violates road traffic regulations and causes a road traffic accident, in which a large number of people die every year, the right to life and health of a person protected by the Constitution of the Republic of Latvia is affected. The aim of the master's thesis is to analyze the legal framework of preventive measures in the field of road safety, its problems and provide solutions to the problems. The author of the paper, during the research, found that there are problems in the legal regulation of road traffic safety preventive measures, which are related to: 1) 1) the lack of employees of the State Police and the limited functions of the Local Government Police in the field of road traffic, which hinder the operative detection of violators of road traffic regulations and their calling to administrative or criminal liability provided for in regulatory enactments, 2) restriction of the possibilities of choosing the applicable administrative penalties, which reduces the possibilities to choose the most effective administrative penalty that would deter road traffic offenders from committing repeated offenses in the field of road traffic. In order to solve the identified problems, the author proposes to make amendments to the following regulatory enactments related to road traffic prevention - the Law on Administrative Liability, the Road Traffic Law the Cabinet of Ministers in Regulation no. 719. 27.11.2018. "Procedures for Determining the Concentration of Alcohol in Blood and Exhaled Air and Determining the Effects of Narcotic Drugs or Other Intoxicating Substances".
