dc.description.abstract | Ņemot vērā operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta veikšanas specifiku, dažkārt rodas situācijas, kad nepareizās tiesību normas iztulkošanas un interpretācijas dēļ operatīvā eksperimentā un speciālā izmeklēšanas eksperimentā laikā iegūtā informācija tiek atzīta par nelikumīgi iegūtu. Par tādas problēmas pastāvēšanu liecina kā Latvijas tiesu prakse, tā arī ārvalsts tiesu prakse un ECT prakse. Darbā tiek analizētas operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta jēdzieni un to būtība, operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta veikšanas priekšlikumi un nosacījumi, personas identificēšanas nosacījumi un operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta veikšanas tiesiskuma kontrole. Darbā procesā ir konstatētas Operatīvās darbības likuma un Kriminālprocesa likuma nepilnības, kuras ir saistītas ar operatīvā eksperimentā un speciālā izmeklēšanas eksperimentā veikšanas nosacījumiem un tiesiskuma kontroles mehānismu. Darbā rezultātā tiek piedāvāti likuma grozījumi un sniegti priekšlikumi operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta taktikas uzlabošanai. Autors uzskata, ka pētījuma temats ir aktuāls un pētījuma rezultātā iegūtās atziņas var izmantot gan pilnveidojot operatīvā eksperimenta un speciālā izmeklēšanas eksperimenta tiesisko regulējumu, gan reālās praktiskajās situācijās. | lv-LV |
dc.description.abstract | The specifics of conducting an operational experiment and a special investigative experiment, sometimes arise situations when, due to incorrect interpretation of a legal norm, information obtained during an operational experiment and a special investigative experiment is recognized as illegally obtained. The existence of such a problem is evidenced by the practice of Latvian courts, as well as the practice of foreign courts and the practice of the European Court of Human Rights. In work are analyzed concepts and essence of operative experiment and special investigative experiment, conditions for conducting operative experiment and special investigative experiment, conditions of personal identification and control of legality during operative experiment and special investigative experiment. The flaws in the Law on Operational Activities and the Law on Criminal Procedure, which are related to the conditions for conducting an operative experiment and a special investigative experiment and the mechanism of control of legality, are identified in the process. As a result of the work, amendments to the law are proposed and suggestions for improving the tactics of the operational experiment and the special investigation experiment are provided. The author believes that the topic of the research is actual and the findings obtained as a result of the research can be used both in improving the legal framework of the operative experiment and the special investigation experiment, and in real practical situations. | en-UK |
