Abstract

Maģistra darba temats ir “Saprātīgs termiņš kriminālprocesā”, kas izvēlēts, ņemot vērā pārmērīgi ilgstošo kriminālprocesu iztiesāšanu vairāku gadu garumā, ko raksturo publiskās telpas un nozaru speciālistu pievērstā uzmanība kriminālprocesa iztiesāšanas ilgumam. Kā arī ikdienas darbā un mācību procesā nereti nākas sastapties ar gadījumiem, kad netiek sekmīgi nodrošināta saprātīga termiņa principam atbilstoša izmeklēšana, kas ir galvenais faktors temata aktualitātei. Maģistra darba mērķis ir izpētīt un analizēt iemeslus saprātīga termiņa pārkāpumiem un apstākļus, kas jāievēro, lai netiktu pārkāptas tiesības uz kriminālprocesa pabeigšanu saprātīgā termiņā, konstatēt nesakritības normatīvajā regulējumā un praksē, lai rastu risinājumus to novēršanai. Lai sasniegtu maģistra darba mērķi, maģistra darba ietvaros pētīti normatīvie akti, biežie un apjomīgie KPL grozījumi, to likumprojekti un anotācija, apzināti pētījumi un periodiskie izdevumi, juridiskā literatūra par attiecīgo tematu, analizēti tiesu prakses materiāli. Maģistra darba rezultātā secinātas kriminālprocesa pabeigšanas saprātīgā termiņā institūta nepilnības normatīvajā regulējumā un praksē, izvirzīti risinājumi to novēršanai. Maģistra darba apjoms – 70 lapas.

The subject of the Master's Thesis is “Reasonable Term in Criminal Proceedings”, which has been chosen considering excessively prolonged Criminal proceeding trials for several years, characterized by the attention paid to the length of Criminal proceeding trials by public spaces and by experts of various sectors. As well as in my daily work and study process often there are cases when appropriate investigation according to the principles of reasonable terms is not successfully ensured, which is the main factor in the topicality of the subject. The objectives of the Master's Thesis is to study and analyze the reasons for violation of proceedings within a reasonable terms and circumstances that must be observed in order not to violate the right to complete criminal proceedings within a reasonable term, and to identify discrepancies in legal frameworks and practices in order to find solutions to prevent them. In order to achieve the objectives of the Master's Thesis, regulatory enactments was studied within the framework of a Master's Thesis, including frequent and voluminous amendments in Criminal Procedure Law their draft legal acts and annotation, deliberate studies, periodical and legal literature on the relevant subject and court practice materials were analyzed. As a result of the Master's Thesis the shortcomings to the completion of criminal proceedings in a reasonable term in normative regulation and practice have been concluded, solutions for their elimination have been proposed.
